S S ECOR * - " <br /> Rusty answered that the L&M Group intends to complete the Unocal OU excavation this summer, <br /> build a temporary parking lot, and then next spring-summer to complete the pipeline removal at <br /> the Waterfront Towers property. <br /> 3. Human Health Risk Assessment <br /> Rusty stated that Earth Tech is currently completing the human health risk assessment (HHRH) <br /> and SECOR has no part in the development of the HHRH. <br /> Tracy stated that the HHRA is complete and is currently with the Department of Toxic Substances <br /> Control (DTSC). <br /> Mary stated she has weekly talks regarding the HHRA and things are moving along. <br /> Rusty stated that the HHRA will be used to develop site specific cleanup goals. <br /> Mary stated that groundwater cleanup goals will come from somewhere else and the HHRA will <br /> not be used for groundwater cleanup numbers. <br /> Tom stated that the cleanup goals we are discussing are for the Settlement Agreement. <br /> Mary referred to the Porter-Cologne which states that all water of the State is drinking water and <br /> those goals will be used. <br /> Rusty asked'What is the policy for no further action based on a downward trend?" <br /> Mary responded that it is case by case, based on a technical approach and reasonable timeline. <br /> -Tracy left the meeting(ended his call)- <br /> 4. Parcel 2A Land Use <br /> Rusty stated that as part of the Settlement Agreement the L&M OU and Unocal OU will be <br /> cleaned to residential standards; the Waterfront Towers property to Commercial standards. <br /> Mary asked how the 5 year completion date was established in the Settlement Agreement. <br /> Robert answered that the 5 years was based on soil excavation and groundwater treatment and <br /> the need to complete these activities within the current timeline for site development. <br /> Robert mentioned that allocation of groundwater responsibility is another issue that is not yet <br /> resolved in the Settlement Agreement. Both sides have come together to prepare a plan to try to <br /> resolve that issue. <br /> 5. Cleanup Strategy/Schedule of Activities <br /> Mary stated that she still does not understand why not to go ahead with the excavation as <br /> planned. <br /> Kitty stated that the Polanco Agreement is necessary before the RDA can authorize work. <br /> Mary stated that the Polanco has no bearing on the planned excavation. <br /> Kitty disagreed and stated her legal counsel tells her otherwise. <br /> -Duncan Austin now joins the meeting- <br /> Robert said that the RDA does not agree with the work plan. <br /> 4 <br />
