substances at the Site, including, but not limited to, releases from any leaking underground <br /> storage tanks and/or related releases, and all adjacent sites that may be impacted by releases of <br /> hazardous substances, including, but not limited to, releases from leaking underground storage <br /> tanks on the Site. All work performed by the REDEVELOPMENT AGENCY shall be <br /> conducted in compliance with applicable laws, regulations, and policies, including Water Code <br /> Division 7 and associated regulations,plans, and policies, and in conformance with the priorities, <br /> guidelines, and criteria reflected in WATER BOARD guidance documents regarding site <br /> investigation and remediation. <br /> 3.1 Scope of Work and Oversight. The REDEVELOPMENT AGENCY shall <br /> request cleanup guidelines from the WATER BOARD before taking action to remedy or remove <br /> a release. The WATER BOARD shall provide cleanup guidelines and/or on-going oversight <br /> activities within a reasonable period of time. The REDEVELOPMENT AGENCY shall submit <br /> for approval site investigation documents, cleanup and remedial action plans, and <br /> implementation documents to implement remedial measures, signed and stamped by a qualified <br /> registered professional, to the WATER BOARD before taking action to remedy or remove a <br /> release. The WATER BOARD shall respond within a reasonable period of time.' The <br /> REDEVEDLOPMENT AGENCY shall implement the approved investigations and plans. The <br /> site investigation and cleanup and remedial action at the site is an iterative process. The <br /> REDEVELOPMENT AGENCY shall conduct the work as described in and in accordance with <br /> Exhibit C• Scope of Work including a Time Schedule, an attachment incorporated herein by this <br /> reference, , which may be periodically modified as necessary until site cleanup is complete <br /> consistent with applicable law and the Polanco Redevelopment Act. WATER BOARD shall <br /> review and provide the REDEVELOPMENT AGENCY with written comments on all <br /> deliverables as described in Exhibit C: Scope of Work, . The REDEVELOPMENT AGENCY <br /> shall implement the Monitoring and Reporting Program R5-2003-0803, and any subsequent <br /> revisions by the WATER BOARD Executive Officer. WATER BOARD shall provide <br /> oversight of field activities, including sampling, and removal, and/or remedial activities, as <br /> deemed appropriate by theWATER BOARD. Upon approval of cleanup or remedial action <br /> plans submitted to address releases of hazardous substances at the Site in compliance with <br /> applicable laws, regulations, and policies, WATER BOARD shall acknowledge, in writing <br /> within sixty (60) days of approval, pursuant to H&SC section 33459.3(b), that upon proper <br /> completion of the cleanup, remedial or removal action in accordance with the cleanup or <br /> remedial action plan, and in accordance with applicable laws and regulations, and policies, the <br /> immunity provided in H&SC section 33459.3 shall apply to the REDEVELOPMENT AGENCY. <br /> WATER BOARD's completion of activities described above shall constitute WATER BOARD's <br /> complete performance under this Agreement. <br /> 3.2 Additional Activities. Activities which are outside the scope of this Agreement <br /> may be conducted and additional WATER BOARD oversight may be provided by amendment to <br /> this Agreement. If WATER BOARD expects additional oversight costs to be incurred, it will <br /> provide an estimate of the additional oversight cost to the REDEVELOPMENT AGENCY. <br /> 3.3 Review and Approval. If WATER BOARD determines that any report, plan, <br /> schedule or other document submitted for approval pursuant to this Agreement fails to comply <br /> with applicable laws, regulations, and policies, fails to comply with this Agreement, or fails to <br /> protect public health or safety or the environment, WATER BOARD may (a) return comments to <br /> 4 <br />
