In the event WATER BOARD <br /> determines that any activity (whether or not pursued in compliance with this Agreement) may <br /> pose an imminent or substantial endangerment to the health and safety of people on the Site or in <br /> the surrounding area or to the environment, the REDEVELOPMENT AGENCY, through its <br /> employees, agents and, or, assigns shall stop further implementation of this Agreement for such <br /> period of time as may be needed to abate the endangerment. <br /> 3.6 Cost Estimates and Payment. Pursuant to H&SC section 33459.4, the <br /> REDEVELOPMENT AGENCY agrees to pay all costs incurred by WATER BOARD in <br /> providing oversight pursuant to this Agreement, including review of the documents described in <br /> Exhibit C and associated documents. An estimate of WATER BOARD's oversight costs for <br /> activities conducted through June 30, 2006 are stated in Exhibit D: Central Valley Regional <br /> Water Quality Control Board: Cost Estimate for Morton-Alco Remediation Project an <br /> attachment incorporated herein by this reference. Cost estimates shall include all labor, <br /> materials, and expenses incurred by WATER BOARD in performing the services contemplated <br /> by this Oversight Agreement. Future cost estimates will be provided annually in compliance with <br /> Water Code section 13365. <br /> 5 <br />
