k Phase l Environmental Site Assessment City of Stockton Multi-Modal Station/Shopping Center " Page 4 practically reviewable In other words, when so much data is generated that it cannot be feasibly reviewed for its impact on the property, it is not practically reviewable 7, 1 0 ASTM 3 3 29 Publicly available —Information that is publicly available means that the source of the information allows access to the information by anyone upon request 1 ASTM 3 3 30 Reasonably ascertainable — For purposes of both this practice and Practice E 1528, information that is (1)publicly available, (2) obtainable from its source within reasonable tune and cost constraints, and(3)practically reviewable ASTM 3 3 43 Visually and/or physically observed— During a site visit pursuant to Practice E 1528, or r pursuant to this practice, this term means observations made by vision while walking through a property and the structures located on it and observations made by the sense of smell, particularly observations of noxious or foul odors The term "walking through" is not meant to imply that disabled persons who cannot physically walk may not conduct a site visit, they may do so by the means at their disposal for moving through the property and the structures located on it . 14 LIMITATIONS AND EXCEPTIONS Condor performed this environmental assessment in accordance with the guidelines set forth in the ASTM E 1527-00 Standard Practice for Environmental Site Assessments Phase I Environmental Site Assessment Process This ASTM Phase I ESA is thorough, but it is not intended to identify all potential concerns or to eliminate all risk of the subject property(ies) bearing some degree of environmental Itability Condor cannot, and will not, warrant or certify that the site is free of contaminants because it is impossible to know if such a condition exists Although risks can never be eliminated, more detailed and extensive investigations yield more information The scope of this project was presented in our proposal and contract number 2993 dated September 8, 2000 and subsequently approved by the client on December 13, 2000 The scope of work for this report is intended to provide an appropriate inquiry into the previous ownership and uses of the property to satisfy the innocent landowner defense to CERCLA liability The scope of work for this project was limited to a A qualitative evaluation of environmental concerns associated with the potential presence of hazardous materials in conjunction with current and previous activities on the site and did not include other services that are not described in this report Specifically excluded from the scope of work are (1)the evaluation of the site for the presence of asbestos, radon, and lead-based paint, (2) a survey of the site for wetlands or rare and endangered species, (3) a survey of the site for historical or cultural resources, and (4) research into the title history of the site The site reconnaissance of the site was incomplete due to limited access to 4t some commercial properties and denied access to some commercial properties Residences were not included in the site reconnaissance .interviews were not conducted with all property owners or managers Condor has completed the ASTM Phase I ESA, as an environmental professional, in accordance with the ASTM guidelines and with the customary state of the practice and the prevailing standard of care for completing such assessinents in California at this time Condor shall not be subject to any express or implied warranties whatsoever The property owner is solely responsible for notifying all governmental agencies and the public at large of the existence, release,treatment, or disposal of any hazardous materials observed at the site, either before or during performance of Condor's services Condor assumes no responsibility or liability whatsoever for any claim, loss of property value, damage, or injury which results from pre-existing hazardous materials being encountered or present on the site, or from the discovery of such hazardous materials Client shall notify property owners of their reporting requirements v i t� CONDOR
