William Smith, Fish Hatchery Manger II provided a Safety Data <br />Sheet (SDS) for the Aluminum used at this facility. The SDS indicated that this metal also contains chromium, zinc, <br />and copper. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop <br />recycling metal fines, make a hazardous waste determination for the metal fines, and manage it according to Title 22 <br />hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the metal is <br />determined to be a hazardous waste. Submit a statement and supporting documentation explaining how this waste <br />was managed. <br />West of hazardous waste storage shed were three open partially full containers of product that appeared to no longer <br />be used according to the manufacturer's intended purpose. There were two blue open five gallon containers with a <br />label identifying the contents as a multi purpose epoxy and a black open five gallon container with a label identifying <br />the contents as a transparent stain and sealer with V.O.C. Any person who generates a waste shall determine if the <br />waste is a hazardous waste. Immediately make a hazardous waste determination for these three open partially full <br />containers of product that appeared to no longer be used according to the manufacturer's intended purpose, and <br />manage it according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation <br />explaining how this waste was managed. <br />This is a minor violation. <br />103 CCR 66262.34(d)(2) No modified contingency plan. <br />An emergency coordinator and modified contingency plan information is lacking. There must be at least one <br />emergency coordinator on site or on call to coordinate emergency response measures, and the following information <br />must be posted by a phone: the name and phone number of the emergency coordinator; location of fire <br />extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, unless <br />the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required information by a <br />phone. A form is provided that can be used for this purpose. <br />This is a repeat violation, Class II. <br />403 CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br />waste. <br />In the hazardous waste storage shed is an open unlabeled white five gallon bucket in which used oil was found. All <br />hazardous waste containers shall be closed at all times except when adding or removing waste. During the <br />inspection, William Smith placed the bucket upside down into the used oil drum funnel to drain the used oil out of this <br />bucket. Continue to ensure all hazardous waste containers are closed when not adding or removing waste. <br />This was corrected on site. <br />This is a minor violation. <br />Page 4 of 6 <br />
