determination for waste liquid found in a 55 -gallon drum had not been made, and an <br />empty, contaminated 55 -gallon drum was not marked with the date it was emptied <br />(Attachment 4). <br />On October 31, 2006, notification was received for an UST monitoring system <br />certification, which was scheduled for November 9, 2006. <br />On November 9, 2006, Mr. von Flue witnessed the UST monitoring system certification <br />(Attachment 5), which was billed at EHD's hourly rate. All sensors, leak detectors, and <br />spill containers passed, and Mr. von FlUe did not find any additional violations during the <br />inspection (Attachment 6). Mr. von Flue also approved the facility's monitoring and <br />response plans while on site. <br />On December 1, 2006, Mr. von Flue sent a follow-up letter by certified mail to the <br />facility regarding the items required on the UST and hazardous waste inspection reports <br />dated October 30, 2006 (Attachment 7). None of the items noted in the respective <br />inspection reports were ever corrected or submitted. <br />On November 15, 2007, Mr. von Flue performed a routine UST inspection (Attachment <br />8) and witnessed the annual monitoring system certification, leak detector testing, and <br />spill container testing. Current financial responsibility documents were not on file with <br />this office, and the certification for their current designated operator, Ms. Lori Freshour, <br />was expired as of September 17, 2007 (Attachment 9). The June and October 2007 <br />monthly designated operator reports were not found on site. Fuel leaks were found <br />underneath two of the dispensers. The 91 -octane leak detector failed to detect a 3.0 <br />gallon per hour leak at 10 psi, and the 91 -octane spill container failed a hydrostatic test. <br />The monitoring system certification test report was submitted late (by fax) to this office <br />on December 21, 2007, and by mail on January 14, 2008. The mailed copy is included as <br />an attachment for clarity (Attachment 10). <br />On November 16, 2007, a permit application, SR0052621, was submitted to replace the <br />91 -octane leak detector and spill container. This permit was approved by Mr. von Flue <br />on November 19, 2007 (Attachment 11). <br />On November 19, 2007, a designated operator statement was submitted with a new <br />designated operator for this facility (Attachment 12). <br />On November 21, 2007, Mr. von Flue verified corrosion protection on the 91 -octane fill <br />riser (Attachment 13). <br />On November 30, 2007, Mr. von Flue, Ms. Stacy Rivera, San Joaquin County <br />Environmental Health Specialist Trainee (EHST), and Mr. Aris Cacapit, EHST, <br />witnessed testing of the new 91 -octane leak detector and hydrostatic testing of the new <br />91 -octane spill container. Both tests passed and Ms. Rivera wrote an inspection report <br />that Mr. von Flue signed (Attachment 14). <br />W <br />
