No person may own or operate an UST unless a permit for its operation has been issued by the local agency to the owner or operator of the UST system. Immediately obtain a permit to operate a UST system from the EHD. An "Operating without a Permit" penalty applies. This is a Class I violation. 102 HSC 25284(a)(3) No written agreement between tank owner and tank operator to monitor the tank system. The annual operating permit is not issued to the current operator and there is no written agreement between the person who was issued the permit and the operator to monitor the UST system. If a permit is issued to a person other than the operator of the tank, that person shall enter into a written agreement with the operator of the tank to monitor the UST system. Immediately submit a copy of this written agreement to the EHD. Alternatively, log into CERS, upload the written agreement, and submit for review by the EHD. This is a minor violation.
