(Attachment 1) On November 15, 2002, a certified letter was mailed to the <br />facility stating it was their final notification to perform secondary containment testing by January <br />1, 2003. (Attachment 2) In addition, numerous CUPA newsletters were mailed to the facility <br />stating the secondary containment test deadline. (Attachment 3) <br />On November 25, 2002, the referenced facility was mailed a letter stating they needed to perform <br />their annual monitoring certification, line leak detector test and line tightness test by December <br />26, 2002. (Attachment 4) The required tests were not performed. <br />On December 21, 2002, the referenced facility was tested for secondary containment by Johnson <br />Tank Testing. The test report stated this facility has a fiber trench secondary system, which can't <br />be tested. (Attachment 5) California Code of Regulations (CCR), Section 2637(a)(1), requires <br />that by December 31, 2002, the owner or operator of any secondary containment system that the <br />owner or operator determines cannot be tested in accordance with this section shall replace the <br />secondary containment system with a system that can be tested in accordance with this section. <br />On March 7, 2003, Steven C. Shih, RENS, performed a routine underground storage tank (UST) <br />inspection. At the time of inspection, the facility was issued a report (Attachment 6) stating that <br />Environmental Health Department (EHD) will not issue a UST permit to this facility due to the <br />violation of the secondary containment test requirement. In addition, this facility must perform <br />an annual monitoring certification, line leak detector and line tightness test immediately. <br />Furthermore, Mr. Shih also required this facility to immediately investigate the alarm showing <br />on the monitoring panel. <br />BonFare Market #35 1/4 <br />15 E.
