(e) follow all operating procedures specified by BPWCP; <br />(f) immediately report to BPWCP all suspected or confirmed releases from the tanks and connected <br />piping system, unusual operating conditions, release detection signals and environmental conditions <br />suggesting a release may have occurred, and any spills and overfills that are not contained and cleaned <br />up; <br />(g) properly close the underground tanks as required by law; and, <br />(h) comply with all federal, state, and local legal requirements relevant to the operations of the <br />underground tanks and all amendments to any permit to operate. <br />4. With respect to the operation of the underground storage tank system and monitoring equipment, <br />Franchisee hereby acknowledges and agrees: <br />- that BPWCP has provided Franchisee with training on each of the items described in the <br />attached Monitoring and Response Plan, <br />- that Franchisee understood the content of the training, and asked any questions necessary <br />to facilitate his understanding, <br />- that Franchisee indicated to BPWCP at the time of training any subjects addressed by the <br />training which Franchisee did not fully understand, and, <br />- that Franchisee received complete training and information necessary for Franchisee to <br />fully understand the subject of operating underground storage tanks. <br />5. BPWCP has provided Franchisee a copy of and Franchisee agrees to maintain on the Premises <br />the Certificate of Financial Responsibility (as required by the United States Environmental Protection <br />Agency in Subpart H, 40 CFR, Part 280 and California Health and Safety Code, Chapter 6.7, Section <br />25292.2). <br />6. Except to the extent that conflict with, or are less rigorous than the terms of this Amendment, all <br />of the terms and conditions of the PMPA Agreement, as previously or hereafter amended or <br />supplemented, remain in full force. <br />IN WITNESS WHEREOF, BPWCP and Franchisee have executed this Amendment. <br />BP West Coast Products LLC <br />THIS AMENDMENT <br />Franchisee <br />AND THE ATTACHMENT MUST BE MAINTAINED AT THE FACT . <br />VAlfree!rnar/dReali Date <br />Witness Date <br />
