BP West Coast Products LLC Facility Number: 05450 Customer Account Number: 0993212 AMENDMENT TO LESSEE PMPA FRANCHISE AGREEMENT/DEALER/PREMISES LEASE OPERATION OF UNDERGROUND STORAGE TANKS CALIFORNIA This Amendment, dated , is attached to, incorporated in and made a part of the Lessee PMPA franchise Agreement/Dealer/Premises Lease ("PMPA Agreement"), in effect as of the date of this Amendment or, if applicable, to become effective concurrently with this Amendment, between BP West Coast Products LLC (BPWCP), a Delaware limited liability company, and Alfred Bernard Reali ("Franchisee"), covering premises located at 1617 W. Fremont Stockton CA 95203. In return for good and valuable consideration, each party's receipt of which is hereby acknowledged, the parties agree as follows: 1. The parties have entered into this Amendment in accordance with legal requirements imposed on BPWCP and Franchisee concerning operation of the underground storage tanks at the above -referenced location. 2. BPWCP has provided Franchisee a copy of: (a) California Health and Safety Code Section 25299 or an approved summary concerning civil and criminal penalties for violating terms of any permit to operate these underground storage tanks and relevant statutory and regulatory requirements; (b) the following listed documents, a copy of which is attached and initiated by Franchisee: Monitoring and Response Plan 3. Where BPWCP has provided Franchisee with a copy of the permit to operate the underground storage tanks, Franchisee has read and understood its responsibilities as operator under the permit and agrees to comply with each of the provisions of the permit. Irrespective of whether Franchisee has received and reviewed a copy of the underground storage tank operating permit, Franchisee hereby expressly agrees to do the following: (a) monitor the underground tanks as required by law; (b) maintain all required records and make such records available to the federal, state, and local government agencies and to BPWCP at all reasonable times; (c) follow all reporting procedures as required by law; (d) mail, when submitted to, BPWCP, at the address specified in paragraph 1 of the PMPA Franchise Agreement/Dealer/Premises Lease, a copy of all reports submitted to overnment agencies;
