BP West Coast Products LLC Facility Number: 05450 <br />Customer Account Number: 0993212 <br />AMENDMENT TO LESSEE PMPA FRANCHISE AGREEMENT/DEALER/PREMISES LEASE <br />OPERATION OF UNDERGROUND STORAGE TANKS <br />CALIFORNIA <br />This Amendment, dated , is attached to, incorporated in and made a <br />part of the Lessee PMPA franchise Agreement/Dealer/Premises Lease ("PMPA Agreement"), in effect as <br />of the date of this Amendment or, if applicable, to become effective concurrently with this Amendment, <br />between BP West Coast Products LLC (BPWCP), a Delaware limited liability company, and Alfred <br />Bernard Reali ("Franchisee"), covering premises located at 1617 W. Fremont Stockton CA 95203. <br />In return for good and valuable consideration, each party's receipt of which is hereby acknowledged, the <br />parties agree as follows: <br />1. The parties have entered into this Amendment in accordance with legal requirements imposed on <br />BPWCP and Franchisee concerning operation of the underground storage tanks at the above -referenced <br />location. <br />2. BPWCP has provided Franchisee a copy of: <br />(a) California Health and Safety Code Section 25299 or an approved summary concerning civil and <br />criminal penalties for violating terms of any permit to operate these underground storage tanks and <br />relevant statutory and regulatory requirements; <br />(b) the following listed documents, a copy of which is attached and initiated by Franchisee: <br />Monitoring and Response Plan <br />3. Where BPWCP has provided Franchisee with a copy of the permit to operate the underground <br />storage tanks, Franchisee has read and understood its responsibilities as operator under the permit and <br />agrees to comply with each of the provisions of the permit. Irrespective of whether Franchisee has <br />received and reviewed a copy of the underground storage tank operating permit, Franchisee hereby <br />expressly agrees to do the following: <br />(a) monitor the underground tanks as required by law; <br />(b) maintain all required records and make such records available to the federal, state, and local <br />government agencies and to BPWCP at all reasonable times; <br />(c) follow all reporting procedures as required by law; <br />(d) mail, when submitted to, BPWCP, at the address specified in paragraph 1 of the PMPA Franchise <br />Agreement/Dealer/Premises Lease, a copy of all reports submitted to overnment agencies; <br />
