CARB may sample and test the transmix at the Kinder Morgan, Stockton Station <br /> for determining compliance with the transmix limits in this protocol. <br /> The conditions of this protocol do not prohibit CARB from taking enforcement action <br /> based upon evidence that the transmix blending caused a significant effect on the <br /> CARBOB. <br /> Conclusion <br /> Kinder Morgan, Stockton Station and CARB agree that: <br /> 1. This protocol automatically terminates without notice on the.effective date of any <br /> amendments to the Phase 3 California Reformulated Gasoline regulation, if the <br /> amendment changes any of the applicable CARBOB cap limits. <br /> 2. Except as provided in 1. above, either party may terminate this protocol by <br /> providing thirty (30) days advance written notice. CARB will initiate such <br /> termination only for just cause which may include Kinder Morgan's failure to <br /> comply with the material provisions of this protocol, or if CARB determines that <br /> the protocol provisions are less stringent or enforceable than the application of <br /> the express terms of the regulations. <br /> Upon correcting the faults that caused the termination, Kinder Morgan may apply for <br /> reinstatement of this protocol or for a new protocol.
