In addition,the facility could only provide one disposal record <br /> for used oil (dated 6/17/2020). According to the manager,Victor Torres, used oil is picked up 1-2 times a year. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years(6/18/2017-6/18/2020)for used <br /> oil and oily absorbent. Provide these records and a corrective action statement to the EHD within 30 days. <br /> OBSERVATION 2: According to Victor Torres, Freon Free takes used Freon and Freon Filters from the facility to <br /> recycle the waste. The facility could not provide any documents showing the Freon taken out of the appliances is <br /> being properly reused or recycled. <br /> REGULATION GUIDANCE: Per California Health and Safety Code 25143.2(d): Except as otherwise provided in <br /> subdivisions(e), (f), (g), and (h), recyclable material that meets the definition of a non-RCRA hazardous waste in <br /> Section 25117.9, is managed in accordance with Section 25143.9, and meets or will meet any of the following <br /> requirements is excluded from classification as a waste: <br /> (7) The material is a chlorofluorocarbon or hydrochlorofluorocarbon compound or a combination of <br /> chlorofluorocarbon or hydrochlorofluorocarbon compounds, is being reused or recycled, and is used in heat transfer <br /> equipment, including, but not limited to, mobile air-conditioning systems, mobile refrigeration, and commercial and <br /> industrial air-conditioning and refrigeration systems, used in fire extinguishing products, or contained within foam <br /> products. <br /> CORRECTIVE ACTION: Immediately provide documentation and a statement to the San Joaquin County <br /> Environmental Health Department showing the Freon waste is being properly reused or recycled. Include any Freon <br /> disposal records from 6/18/2017-6/18/2020.
