Jim Crandell 2 - 8 October 2003
As a result of the review of groundwater quality, Robert Mondavi Winery is hereby required to prepare
and submit a Groundwater Degradation Evaluation Report that describes the source of the contaminants
in the groundwater and confirms whether or not the facility's discharge of winery waste is degrading the
groundwater. This evaluation shall be completed under the supervision of a California Registered
Engineer or Registered Geologist. If the existing data is insufficient to complete the required evaluation,
then the technical report shall also contain a proposal and timeline for the installation of additional
monitoring wells and/or additional measures to provide the necessary data and complete the required
evaluation.
By 15 November 2003, Robert Mondavi Winery shall submit a letter identifying and describing the
registered professional who has been retained to conduct the assessment.
By 15 January 2004, Robert Mondavi Winery shall submit the above-described report.
If the Groundwater Degradation Evaluation Report confirms that Robert Mondavi Winery has degraded
the groundwater, then the Discharger will be required to evaluate its waste treatment and disposal system
for consistency with applicable plans and policies, particularly State Water Resources Control Board
Resolution No. 68-16, the "Antidegradation Policy." This policy, which is implemented on a
constituent-by-constituent basis, essentially requires that discharges that result in groundwater
degradation undergo Best Practicable Treatment and Control (BPTC) measures to assure (a) that a
condition of pollution or nuisance will not occur and(b)that the highest water quality consistent with
maximum benefit to the people of the State will be maintained. Following a BPTC evaluation,Robert
Mondavi Winery would be required to propose and complete facility improvements such that BPTC
measures consistent with the Antidegradation Policy are implemented.
Degradation of the underlying groundwater is a violation of both WDRs Discharge Specification B.1
which states, "The operation shall not cause pollution or nuisance or condition of pollution as defined by
California Water Code, Section 13050," and WDRs Discharge Specification B.2,which states, "The
discharge shall not cause degradation of any water supply."
If you have any questions about this request for a technical report, please contact Tim O'Brien at
(916) 255-3116.
WE YWYELS, Chief
Waste Discharge to Land Unit
enc: Site Map
cc: Mike Huggins, San Joaquin County Environmental Health Department, Stockton
