Document Number: 909 R 5003 <br />Procedure Rev: 12 Date: 1/22/13 <br />EMERGENCY RESPONSE PROCEDURES <br />Definitions <br />Dawn Raid - Unannounced visits by a competition authority to a business premises <br />or private homes with the intent to confiscate evidence of competition law <br />infringement. This type of activity is conducted by European competition <br />authorities and certain Asian countries such as China and Japan. <br />Search Warrant — An order signed by a judge that authorizes the government <br />investigators to search for specific objects, materials or documents at a definite <br />location at a specified time. This is a legal requirement in certain countries such as <br />the United States. <br />To enforce competition law, competition regulators usually have extensive powers to <br />investigate, including the power to carry out investigations on the spot without prior <br />notice. Depending upon the jurisdiction, investigators may have the power to <br />examine and seize or copy all evidence of company activities, in particular, internal <br />records as well as external communications. <br />In order to protect company and employee rights and to avoid misunderstandings <br />that could lead to costly penalties or damage to NSG Group's reputation, certain <br />basic steps must be followed whenever contact is made by a government <br />authority. Certain local sites within NSG Group have specific procedures in place for <br />responding to search warrants or dawn raids which embody the basic instructions set <br />below.
