Document Number: 909 R 5003
Procedure Rev: 12 Date: 1/22/13
EMERGENCY RESPONSE PROCEDURES
have shown to you. Investigators cannot review or ask for documents that do not
concern the products, the time period, or the geographic area mentioned in the
authorization. In case of doubt, request that the investigator wait for your lawyer
before reviewing a document whose relevance is in dispute.
2.3.16 Copy Two Sets of all Documents Requested by the Investigators. When
the investigators make copies or ask for copies, make an extra set of copies for the
legal department as a complete record of what has been taken away. The
investigators should supply their own signed record of documents they have taken. If
the investigators demand the original documents, still make two sets of copies; 1)
one set to show a complete record of what has been taken away and 2) to replace
any originals so that business may continue without hindrance.
2.3.17 Take Extreme Care with Oral Questions. Only answer questions that are
perfectly clear and within the sole and personal knowledge of the person responding.
Record all other questions and promise to provide answers in writing as soon as
possible. If in doubt, do not reply to the questions on the spot. Keep a full note, word
for word, of each question and each response.
2.3.18 External Communications. There should be no contact with third parties
concerning the search except with the prior approval of your lawyer.
2.3.19 Debriefing. Once the investigation is complete, arrange a debriefing meeting
with all employees and lawyers involved in the search to go over your notes, the
documents reviewed, investigators' questions and employees' answers and any
matters to be followed up. Follow up matters may include disputes as to relevance or
the privileged status of documents, outstanding questions from the investigators or
any clarification required in relation to information provided. Obtain legal advice
before taking any follow-up action.
H:\profile\My Documents\500 E.
