Contractor agrees to provide real property, here- <br /> inafter referred to as "Site", which .said Site shall be suitable <br /> for the operation and maintenance of garbage and refuse disposal <br /> facilities during the term of this Agreement. <br /> The following described real property, the location <br /> of the receiving facilities and the location of the cut and fill <br /> area on said described property are hereby mutually approved by <br /> the parties hereto: <br /> That certain 29.3 acre parcel of land situated in the <br /> City of Stockton, County of San Joaquin, State of Califor- <br /> nia, between West Charter Way and State Highway 4 and bor- <br /> dering on the San Joaquin River, and designated as 2400 <br /> West Charter Way. <br /> The choice of any future site or sites shall be mutually. agree- <br /> able to the parties hereto, and in the event that the parties <br /> are unable so to agree, this Agreement shall immediately termin- <br /> ate without any liability on the part of either of the parties <br /> hereto. <br /> In the event that the future site mutually agreed upon <br /> is owned by City, rental for said site and the conditions for ' <br /> its use shall be set forth in a separate agreement between the <br /> parties hereto. <br /> 3. Said Site shall be furnished by Contractor with. . <br /> out cost to the City. . Utilities, including lights, power and <br /> water which may be necessary to establish, operate and maintain <br /> said Site and facility shall be furnished by Contractor without <br /> cost to City.. Contractor shall construct and maintain all access <br /> and internal service roads upon the Site without cost to City. <br /> The City shall afford the Contractor access to the Contractor's <br /> Site hereinabove described over the road constructed by Con- <br /> tractor and presently existing from West Charter Way to said Site. <br /> -2- <br />
