8-30-62 It is expressly agreed that Contractor may receive., and dispose of the garbage and refise of persons other than the City or City's agents or licensed collectors, and,the•;City shall from time to time establish a rate for these services. Such a rate shall be compensatory to Contractor and shall be comparable with such rates then in effect in other cities of- fering a similar service. 22. The City shall not be liable or responsible for any accident, loss, injury or damages to persons and/or property happening or accruing during the timethisAgreement is in effect by reason of the establishment, operation or maintenance of the garbage and refuse disposal facility herein referred to and in connection therewith, and the Contractor shall fully indemnify and protect the City from and against the same. In addition to the liability imposed by law upon the Contractor for injury (including death) to persons or damage to property by reason of the negligence of the Contractor or his agents, which liabil- ity is not impaired or otherwise affected hereby, the Contractor hereby assumes liability for and agrees to save the City harmless and indemnify it from every expense, liability or payment by reason of any injury (including death) to persons or damage to property suffered through any act or omission of the Contractor or any of his agents, servants or employees, or anyone directly or indirectly employed by any of them; or arising in any way from the establishment, operation or maintenance of said gar- bage and refuse disposal facility pursuant to this Agreement. As a further precaution toward this end, the Contrac- tar shall procure and maintain in full. force and effect during the time that this Agreement is in effect, insurance in his favor with an insurance carrier approved by the City as follows: -8-
