1 6 . V, , a . <br />11 <br />DEVELOPMENT PLAN CONDITIOM, <br />FOR <br />GAS AND OIL WELLS <br />APPLICATION NO. DP -84-8-7 <br />DATE APPROVED 5-23-84 <br />1. The permitted use shall not at any time develop into <br />nuisance, as herein defined. For the purposes of thi <br />Permit, a nuisance is defined as follows: I <br />"Nuisance is defined as anything resulting from unreasonabl <br />I <br />or unlawful practices or from neglect which is, or tends,to <br />be injurious to health, safety or public welfare or is <br />unsightly or offensive to the senses so as to interfere wit <br />the comfortable enjoyment of life or property in the neigh- <br />borhood area as defined by the Planning Commission or Boar <br />of Adjustment." I <br />2. The Development Plan is hereby made a permanent part of this <br />approved permit and all construction, reconstructiont moving, <br />remodeling or other structural alteration shall be made in <br />conformity therewith. Any variation from said Development <br />Plan shall first be approved by the Planning Director or <br />Board of Zoning Adjustment. <br />3. The Planning Director or Board of Zoning Adjustment may <br />require conditions -greater than set forth in the Zoning <br />Ordinance for Commercial, Manufacturing or Residential (R-4) <br />zones; and may also demand additional requirements for <br />landscaping, visual screens and any other conditions deemed <br />essential to insure the compatibility of a new land use to <br />the neighborhood and, more particularly,,adjacent properties. <br />Approval of the Local Health District. <br />VY <br />5. Approval of the Department of Public Works. <br />6. If toxic materials such as thinning agents are used in the <br />drilling muds, the mud pit must be lined with plastic or <br />other impervious material and the spent mud must be disposed <br />of at a site approved by the Regional Water Quality Control <br />Board, Central Valley Region. <br />rv� <br />
