AMIL Alm. <br />I . <br />10 Prior to the issuance of a Use Permit or Development Plan® a route <br />clearance must be obtained from the County Department of Public Works. <br />in case any portion of any property within San Joaquin County unqer <br />lease by permittee for oil and gas or gas exploration and develop- <br />inent purposes is within one hundred (100) feet of the center line <br />of any public road or highway and additional right-of-way is <br />required for the reconstruction of any such road or highway, the <br />permittee agrees on behalf of himself, the lessee or successors in <br />interest, that all rights as to the surface and upper one hundred <br />(100) feet of the subsurface as measured vertically downward from <br />the surface of such required portion shall be waived upon demand <br />by the proper City, county, or State Department. The aforementioned <br />waiver of rights shall not be required until after an agreement <br />to convey to the City, County, or State, has been secured by <br />the owner, including permittee if permittee by the owner, by such <br />public agency, or said property has been acquired by condemnation, <br />by such public agency. <br />The waiver provided for herein shall not be construed so as to <br />preclude permittee from demanding the receiving compensation for <br />market value of facilities or improvements that may at the time <br />be located on or in said surface or subsurface. <br />12. No facility, device, pipeline, building, or structure, other than <br />approved access roads and service connections for public utilities, <br />shall be placed upon or in the land for which this permit is <br />issued within fifty (50) feet of the center line of any public roai- <br />or highway. <br />Prior to the issuance of a Use Permit or Development Plan, <br />applicant shall first furnish evidence of the fact that he has <br />posted the Surety Bond as required by the State of California <br />Division of Oil and Gas. <br />...4. Mud and waste material from gas and oil well drilling and/or production <br />operations shall not be deposited in the rivers of the County of San <br />Joaquin. <br />
