I . 10 Prior to the issuance of a Use Permit or Development Plan® a route clearance must be obtained from the County Department of Public Works. in case any portion of any property within San Joaquin County unqer lease by permittee for oil and gas or gas exploration and develop- inent purposes is within one hundred (100) feet of the center line of any public road or highway and additional right-of-way is required for the reconstruction of any such road or highway, the permittee agrees on behalf of himself, the lessee or successors in interest, that all rights as to the surface and upper one hundred (100) feet of the subsurface as measured vertically downward from the surface of such required portion shall be waived upon demand by the proper City, county, or State Department. The aforementioned waiver of rights shall not be required until after an agreement to convey to the City, County, or State, has been secured by the owner, including permittee if permittee by the owner, by such public agency, or said property has been acquired by condemnation, by such public agency. The waiver provided for herein shall not be construed so as to preclude permittee from demanding the receiving compensation for market value of facilities or improvements that may at the time be located on or in said surface or subsurface. 12. No facility, device, pipeline, building, or structure, other than approved access roads and service connections for public utilities, shall be placed upon or in the land for which this permit is issued within fifty (50) feet of the center line of any public roai- or highway. Prior to the issuance of a Use Permit or Development Plan, applicant shall first furnish evidence of the fact that he has posted the Surety Bond as required by the State of California Division of Oil and Gas. ...4. Mud and waste material from gas and oil well drilling and/or production operations shall not be deposited in the rivers of the County of San Joaquin.
