not been designated within the 90 days PRC, 43216 J . <br /> The WMple resolution by the Board to conduct a Performance <br /> review is shown in Appendix Y. <br /> Facility listing <br /> In preparation of the Facilities Evaluation Report, staff <br /> not only look at each facility' s current status, but also at each <br /> site' s compliance history. If the Facilities Evaluation Report <br /> identifies facilities with ongoing significant violations of <br /> minimum standards, the Board may direct staff to notify the <br /> operators of intent to include those facilities on the State List <br /> of Non-Complying Facilities (List ) [PRC 44104(b) ] . <br /> Within seven days of Board action, staff must notify a <br /> disposal site owner and operator of the solid waste facility of <br /> Board' s intent to list by certified mail. At least ninety days <br /> from the date of the notification letter, LEA and Board staff <br /> will reinspect the facility (PRC, 44104(b) ] . . If the violation <br /> for which notice was given is not corrected at the time of <br /> reinspection, Board staff will ministerially add the facility to <br /> the List . Within seven days of listing, Board staff must notify <br /> the operator by certified mail. <br /> When a facility is included on the List, the operator will <br /> have one year from the date of Notification of Listing to comply <br /> with the standard( s) which were in violation [PRC, 44106(a) ] . <br /> Within 30 days from the date of the Notification of Listing, the <br /> operator must prepare a compliance schedule which shall ensure <br /> that diligent progress will be made to bring the fACility into <br /> compliance with State Minimum Standards in a timeframe and manner <br /> acceptable to the LEA and the Board (PRC 44106(a) ] . Board and <br /> LEA staff will inspect the facility one year from the date of <br /> listing. If the facility is still in violation at the time of <br /> reinspection, the LEA must initiate procedures to suspend the <br /> solid waste facilities permit [PRC 44106(b) ] . The permit will <br /> only be reinstated upon documented correction of the violations. <br /> After suspension, the operator may petition, in writing, that the <br /> LEA or Board inspect the facility to document correction of <br /> violations. Within 30 days of such petition, the Board and the <br /> LEA must reinspect the facility. <br /> The sample resolution to inventory a solid waste facility <br /> which violates State Minimum Standards is shown in Appendix Z. <br /> Enforcement Actions-Types <br /> LEAs must take appropriate enforcement actions whenever <br /> violations are identified. The primary form of LEA enforcement <br /> action is the Enforcement Order (Notice and Order or Stipulated <br /> Order Of Compliance and Agreement) . <br /> However , w-,en the LEA is not fulfilling the <br /> responsibilities as an enforcement agency or when the Board is <br /> acting as- the enforcement agency, the Board may initiate <br /> appropriate enf :rcement action (PRC, 45000, 45300, 45400, <br /> 60 <br />
