The Board may take the following enforcement actions: <br /> (1) Addinq the facility to the State List of Non-Complying <br /> Facilities [PRC, 44104 (b) ] , as discussed above <br /> (2) Issuing an enforcement order [PRC, 45000, 45300(a) , <br /> 45401] <br /> (3) Approving the use of corrective action funds <br /> [PRC, 45401, 45401(b) ] (loan guarantee and/or contract <br /> funds) <br /> (4) Seeking civil penalties or injunctive relief. [PRC, <br /> 45200 & 45201] <br /> (5) Referring the operator to the State Attorney General <br /> for collection of fees or penalties [PRC, 45506] <br /> The severity of action that the Board may take will depend <br /> upon the nature of the violation(s) . Violations are categorized <br /> as either operational, emergency, permit, or closure/postclosure: <br /> ®rational violations of minimum standards relate to daily <br /> site operations such as daily cover, grading, and litter control. <br /> Emergency violations of minimum standards present an <br /> imminent threat to public health or safety or the environment. <br /> This may include leachate flowing off-site, gas migrating towards <br /> occupied structures, or an underground fire. <br /> permit violations occur when the operator is violating the <br /> terms or conditions of the solid waste facilities permit. Common <br /> permit violations include exceeding the permitted tonnage, <br /> operating outside of the permitted area (expansion) , accepting <br /> waste types(s) not authorized by the permit, or violating State <br /> Minimum .Standards. <br /> Closure/postclosure violations are noted during an <br /> inspection of a closed landfill. <br /> In addition to listing, (which was described in the previous <br /> section on page 60) the Board may exercise one or more of the <br /> following enforcement actions: <br /> F*+gOx'Cement order. <br /> The Board may issue an enforcement order when: <br /> (1) The LEA is not fulfilling its. responsibilities as an <br /> enforcement agency [PRC, 45000] <br /> (2) The Board is acting as the enforcement agency [PRC, <br /> 43300] <br /> An enforcement order may be issued for any of the following <br /> reasons: <br /> (a) operating or proposing to operate a facility in <br /> violation of a solid waste facilities permit [PRC, 45200] <br /> 61 <br />
