Referral to the State Attorney General <br /> In certain instances, the Board may choose to refer a <br /> facility operator and/or owner to the State Attorney .General in <br /> conjunction with, or in lieu of, other enforcement actions. An <br /> operator . and/or owner may be referred to the Attorney General for <br /> the collection of fees or penalties or to seek civil penalties or <br /> injunctive relief [PRC, 45505 6 45506 ] . The Attorney General ' s <br /> office assigns a deputy attorney to the case to negotiate with <br /> the operator/owner and, if necessary, to prosecute. <br /> Corrective actions funds <br /> The corrective actions program is outlined in PRC 45400 et <br /> seq. A corrective action is defined as "any action, required or <br /> approved by an enforcement agency or the Board, a regional Board, <br /> an air quality management district or air pollution control <br /> district, to abate a nuisance or prevent the migration of methane <br /> gas or contaminated ground or surface water as necessary to <br /> protect human health and the environment. " <br /> The Board may allocate funds from the Solid Waste Disposal <br /> Site Cleanup and Maintenance Account to prepare and issue Notice <br /> and Orders pursuant to 14 CCR 18304, (d)3, and to contract for <br /> the preparation and/or implementation of landfill closure and <br /> postclosure maintenance plans and other corrective actions <br /> pursuant to such orders. The corrective actions program is also <br /> directly linked and preeminent to the Loan Guarantee Program, <br /> whereby loan guarantees are made by the Board to landfill owners <br /> or operators to implement corrective actions. <br /> (1) Contract funds - A corrective action contract is a <br /> contract entered into by the Board with a consulting firm, <br /> equipment operator, or other company to implement a corrective <br /> action which has not been voluntarily implemented by a landfill <br /> owner or operator by the date specified in a Notice and Order. <br /> ( 2) Loan guarantees - The Board may make loan guarantees to <br /> a landfill owner or operator to implement a corrective action in <br /> accordance with the eligibility requirements and consistent with <br /> CCR Title 14, Article 4, Section 18304. <br /> Written Notice <br /> Written Notification to other agencies is required within <br /> specific time periods when an enforcement order is being issued. <br /> (Consult PRC, Section 45301 for the. specific agencies. and the <br /> details for noticing. ) <br /> 63 <br />
