Follow-up <br /> BoaCd staff will transmit resolution(s) to affected parties <br /> (LEA and--o rator) immediately following board action. <br /> After the Board issues an operator a Notice and Order or <br /> places a site on the List of Non-Complying Facilities, the Board <br /> must follow-up on any efforts the LEA' s efforts to bring the site <br /> into compliance. In addition, the Board may require the operator <br /> and/or LEA to present regular status reports at the Board <br /> meetings . <br /> If other regulatory agencies are involved, it may be helpful <br /> to form an inter-regulatory agency group to meet regularly to <br /> discuss issues at the site. <br /> Board Acting as Enforcement Agency <br /> The Board is the enforcement agency when there has been no <br /> LEA designation approved within a jurisdiction (PRC, Sec.43202 & <br /> Sec.43205) . <br /> In the event an LEA' s designation is withdrawn by the Board <br /> for failure to fulfill its responsibilities, a new LEA must be <br /> designated for that jurisdiction within 90 days. The Board will <br /> become the enforcement agency within that jurisdiction when a new <br /> LEA has not been designated within the 90 days (PRC, Sec.43216) . <br /> When acting as enforcement agency, the Board is responsible <br /> for the solid waste handling and disposal within the jurisdiction <br /> including at least: monthly inspections of all solid waste <br /> facilities, taking appropriate enforcement actions, processing of <br /> permit applications, reviewing closure and postclosure <br /> maintenance plans, and verifying consistency with COS S. <br /> Enforcement Division staff will be responsible for the <br /> conduct of monthly inspection(s) , for coordinating other <br /> enforcement activities with the Permits, Planning, and Advanced <br /> Technologies Divisions, and accounting for all time spent by <br /> Board staff when acting as' the enforcement agency within a <br /> jurisdiction. <br /> 67 <br />
