III. Environmental Setting, Impacts, and Mitigations <br /> L. Public Health and Safety <br /> Title 22. DTSC regulates Class I hazardous waste landfills but does not regulate Class II or <br /> Class III landfills. <br /> CallOSHA. Cal/OSHA and the Federal Occupational Safety and Health Administration <br /> (Fed/OSHA)are the agencies responsible for assuring worker safety in the handling and use of <br /> potentially hazardous materials in the workplace. In California,Cal/OSHA assumes primary <br /> responsibility for developing and enforcing workplace safety regulations. Cal/OSHA standards <br /> are generally more stringent than federal regulations. <br /> Local <br /> Local officials enforce public health standards developed and mandated by the CIWMB through <br /> Local Enforcement Agencies(LEAs)approved by the CIWMB. The LEA(San Joaquin County <br /> Public Health Services,Environmental Health Division)has the primary responsibility for <br /> ensuring that a solid waste management facility complies with all rules and regulations under its <br /> jurisdiction. The LEA issues Solid Waste Facilities Permits for landfill expansions and <br /> maintains ultimate responsibility for enforcing all provisions pertaining to State minimum <br /> standards for solid waste handling and disposal. The LEA also has the responsibility to protect <br /> public health and safety,prevent environmental damage,and enforce long-term environmental <br /> protection. <br /> Landfill Construction, Qperation.Closure and Post Closure Requirements <br /> The EPA,the SWRCB and the CIWMB have established landfill siting, construction,operation, <br /> closure and post closure requirements. EPA regulations are found in RCRA Subtitle D(40 <br /> CFR); SWRCB regulations are found in CCR,Title 23,and CIWMB regulations are found in <br /> CCR,Title 14. Title 23 deals solely with the protection of water quality while Title 14 deals <br /> with a variety of landfill environmental concerns as well as the protection of water quality. <br /> Public Resources Code,Section 40055 prohibits the CIWMB from adopting regulations that <br /> conflict with the regulations of the SWRCB. <br /> Construction <br /> EPA <br /> Subtitle D regulations and SWRCB Title 23 specify construction standards for new landfills <br /> and lateral expansions of existing landfills. The RWQCB enforces these standards, and a new <br /> landfill must comply-in order to receive its Waste Discharge Requirements(WDRs). <br /> UI.L.4 <br />
