III. Environmental Setting, Impacts, and Mitigations
L. Public Health and Safety
Title 22. DTSC regulates Class I hazardous waste landfills but does not regulate Class II or
Class III landfills.
CallOSHA. Cal/OSHA and the Federal Occupational Safety and Health Administration
(Fed/OSHA)are the agencies responsible for assuring worker safety in the handling and use of
potentially hazardous materials in the workplace. In California,Cal/OSHA assumes primary
responsibility for developing and enforcing workplace safety regulations. Cal/OSHA standards
are generally more stringent than federal regulations.
Local
Local officials enforce public health standards developed and mandated by the CIWMB through
Local Enforcement Agencies(LEAs)approved by the CIWMB. The LEA(San Joaquin County
Public Health Services,Environmental Health Division)has the primary responsibility for
ensuring that a solid waste management facility complies with all rules and regulations under its
jurisdiction. The LEA issues Solid Waste Facilities Permits for landfill expansions and
maintains ultimate responsibility for enforcing all provisions pertaining to State minimum
standards for solid waste handling and disposal. The LEA also has the responsibility to protect
public health and safety, prevent environmental damage, and enforce long-term environmental
protection.
Landfill Construction, Qperation.Closure and Post Closure Requirements
The EPA,the SWRCB and the CIWMB have established landfill siting, construction, operation,
closure and post closure requirements. EPA regulations are found in RCRA Subtitle D(40
CFR); SWRCB regulations are found in CCR,Title 23,and CIWMB regulations are found in
CCR,Title 14. Title 23 deals solely with the protection of water quality while Title 14 deals
with a variety of landfill environmental concerns as well as the protection of water quality.
Public Resources Code,Section 40055 prohibits the CIWMB from adopting regulations that
conflict with the regulations of the SWRCB.
Construction
EPA
Subtitle D regulations and SWRCB Title 23 specify construction standards for new landfills
and lateral expansions of existing landfills. The RWQCB enforces these standards, and a new
landfill must comply-in order to receive its Waste Discharge Requirements(WDRs).
UI.L.4
