Negative <br /> Declaration/Expanded Initial Study for the Austin Road Sanitary <br /> Landfill 5-Year Review <br /> Dear Mr. Carlson: <br /> This is in response to your Environmental Document Transmittal Letter dated July <br /> 9, 1990 and the Notice of Preparation dated July 12, 1990, subject as above. <br /> The subject documents acknowledge the presence of the North Fork South <br /> Littlejohns Creek at the landfill project site, but do not address floodplain <br /> management impact issues that can be evaluated by this office. Therefore, we <br /> cannot provide substantive comment on the proposed project at this time. <br /> We will, however, direct your attention to the fact that the creek is identified <br /> as a floodway on City of Stockton Flood Insurance Rate Map, Community-Panel <br /> Number 060302 0045 D, dated February 4, 1988. The City of Stockton floodplain <br /> management ordinance (Ordinance No. 6-88 C.S. , adopted January 25, 1988), at <br /> Section 13-418(a), prohibits encroachments, including fill, new construction, <br /> substantial improvements, and other developments unless cerification by a <br /> registered professional engineer or architect is provided demonstrating that <br /> encroachments shall not result in any increase in flood levels during the <br /> occurence of the base flood discharge. This ordinance also states, at Section <br /> 13-412(2)(a), that whenever a watercourse is to be altered or relocated, the <br /> City will notify adjacent communities and the California Department of Water <br /> Resources prior to such alteration or relocation of a watercourse, and submit <br /> evidence of such notification to the Federal Insurance Administration. <br /> Please feel free to contact this office at 415-923-7186, if further information <br /> is required. <br /> Sincerely, <br /> tFv v- <br /> Nicholas B.
