CA 95826 Dear Mr. Chen: <br /> (916)255-2200 <br /> _n December 17, 1997,you were sent a Notice of Intent(NOI)to include the Austin <br /> Road Landfill in the Inventory of Solid Waste Facilities Which Violate State Minimum <br /> Standards(Inventory). The NOI indicated that if the ongoing explosive gases control <br /> (Title 27 California Code of Regulations(CCR),section 20919.5)violation was not <br /> corrected within 90 days of receipt of the NOI, the facility would be included in the <br /> Inventory. The 90 day period ended on March 23, 1998. Board staff conducted an <br /> inspection of the facility on March 26, 1998, and noted that landfill gas levels continue to <br /> exceed five percent at the property boundary, a violation of 27 CCR 20919.5. <br /> THEREFORE, YOU ARE HEREBY NOTIFIEDTHAT THE AUSTIN ROAD <br /> LANDFILL HAS BEEN INCLUDED IN THE INVENTORY, PURSUANT TO <br /> PUBLIC RESOURCES CODE SECTION 44104. <br /> Public Resources Code Section 44106(a) requires that a compliance schedule be prepared <br /> which ensures that diligent progress will be made to bring the facility into compliance. <br /> The Austin Road Landfill is currently operating under Stipulated Agreement of <br /> Compliance(Stip)97-77 to address the explosive gases control violation. As required by <br /> the Stip and further specified in Board staff's March 31, 1998 correspondence, a schedule <br /> for expanding the existing landfill gas recovery system is to be submitted by April 27, <br /> 1998. Upon review of the City's proposed schedule, Stip 97-77 may be amended or a <br /> new Stip issued to ensure diligent progress is made to bring and maintain the facility in <br /> compliance with explosive gases control requirements.
