As you recall, the subject of the conversation was the above referenced facility and <br /> facility status. The new owners, Forward Incorporated, have asked to operate the site in a <br /> manner that is not consistent with the current Solid Waste Facilities Permit. The present <br /> request is to allow the operation to take more than the 1200 tons per day of waste. This <br /> increase would allow the remaining air space to be filled in an expedited manner. The <br /> new owners are concerned that at the current rate it would take eight months of operation <br /> to complete the filling of the remaining air space, and leave a short time for construction <br /> of the intermediate cap prior to winter 2001. The new owners realize that to properly <br /> address the ground water issues at the site,the cap needs to be in place. <br /> The Stipulated Notice and Order would be a contract between the LEA and the operator, <br /> in which the operator would be allowed to operate the site in violation of the daily <br /> tonnage condition of the Solid Waste Permit. The Stipulated Notice and Order would <br /> place additional conditions on the operation. The proposal is to allow the facility to <br /> accept 2200 tons per day for a period not to exceed 120 days. The waste would be <br /> diverted from the Forward Incorporated facility and would count against the total tonnage <br /> that could be accepted for both facilities (7860 tons per day). In conversation with Butch <br /> Stephani, the site manager for Forward Incorporate, Mr. Stephani explained that he <br /> would like to start the 120-day period no later than January 02, 2001. Mr. Stephani also <br /> explained that he could expect to start construction on the intermediate cover in July <br /> 2001. <br /> The facility has not operated for over a year; nor was it operated during the transition to <br /> reduce the confusion between the City of Stockton and the prospective buyer, Forward <br /> Incorporate. The transaction was completed on September 1, 2000. Prior to new <br /> ownership the site was subject to erosion problems, leachate seeps, and other operational <br /> problems due to poor engineering and non-responsive previous operators.
