i
PUBLIC HL*ALTH S
SAN JOAQUIN COUNTY
ENVIRONMENTAL HEALTH DIVISION
Karen Furst, M.D., M.P.H., Health Officer
304 East Weber Avenue, Third Floor • Stockton, CA 95202
209/468-3420
November 15, 2000
Ross D. Atkinson
California Regional Water Quality Control Board
Central Valley Region
3443 Routier Road Suite A
Sacramento, California 95827-3003
RE: Austin Road/Forward Landfill located at 9069 Austin Road, Stockton, California
This letter is in response to our telephone conversation that occurred on November 9,
2000. As you recall, the subject of the conversation was the above referenced facility and
facility status. The new owners, Forward Incorporated, have asked to operate the site in a
manner that is not consistent with the current Solid Waste Facilities Permit. The present
request is to allow the operation to take more than the 1200 tons per day of waste. This
increase would allow the remaining air space to be filled in an expedited manner. The
new owners are concerned that at the current rate it would take eight months of operation
to complete the filling of the remaining air space, and leave a short time for construction
of the intermediate cap prior to winter 2001. The new owners realize that to properly
address the ground water issues at the site, the cap needs to be in place.
The Stipulated Notice and Order would be a contract between the LEA and the operator,
in which the operator would be allowed to operate the site in violation of the daily
tonnage condition of the Solid Waste Permit. The Stipulated Notice and Order would
place additional conditions on the operation. The proposal is to allow the facility to
accept 2200 tons per day for a period not to exceed 120 days. The waste would be
diverted from the Forward Incorporated facility and would count against the total tonnage
that could be accepted for both facilities (7860 tons per day). In conversation with Butch
Stephani, the site manager for Forward Incorporate, Mr. Stephani explained that he
would like to start the 120-day period no later than January 02, 2001. Mr. Stephani also
explained that he could expect to start construction on the intermediate cover in July
2001.
The facility has not operated for over a year; nor was it operated during the transition to
reduce the confusion between the City of Stockton and the prospective buyer, Forward
Incorporate. The transaction was completed on September 1, 2000. Prior to new
ownership the site was subject to erosion problems, leachate seeps, and other operational
problems due to poor engineering and non-responsive previous operators. The new
owners have made several improvements to the landfill since taking ownership.
A Division of San Joaquin County Health Care Services
