II. Project Description <br /> The proposed expansion of the Austin Road Landfill is to the north and southeast of the existing <br /> landfill operation. Figure II.1 shows the 405.5-acre project area,including the existing landfall <br /> and the 218.5 acre expansion area. The 218.5 acre expansion area consists of three separate <br /> parcels. Because these three parcels are in the unincorporated area of the County,these three <br /> parcels would require oversight by applicable San Joaquin County Departments. <br /> The first is the 126.4-acre site which was recently acquired by the City from the California <br /> Youth Authority(CYA)which lies directly to the north of the existing landfill. This parcel is in <br /> San Joaquin County and zoned agricultural with the provisions for a solid waste facility. It is <br /> currently vacant and covered with non-native grasses. Per terms of the acquisition,uses of the <br /> CYA parcel for any uses other than a borrow site,composting site,and pre-approved agricultural <br /> use would have to be approved by the CYA. No solid waste fill operations are allowed to be <br /> performed on this parcel. The project proposes to use the CYA parcel as a borrow source and to <br /> house ancillary facilities. Ancillary facilities include the entrance,and administration offices <br /> and a leachate detention pond. Areas within the CYA parcel are also set aside for a Materials <br /> Recovery Facility and a composting or co-composting area. Separate environmental analysis <br /> would be required at the time these facilities are proposed. <br /> The second parcel is the 85.6-acre site owned by Albert Brocchini Farms,Inc.,which is directly <br /> east of the City's 45-acre parcel. The Brocchini parcel is also within San Joaquin County and <br /> zoned agricultural with the provisions for a solid waste facility. Most of this property is covered <br /> with row crops. A residence is luted in the southeast corner of the lot. The City of Stockton <br /> proposes to purchase or condemn this parcel and use it for landfill operations. The northeastern <br /> most comer of the property (approximately 10.3 acres)would be a wildlife preserve/floodplain <br /> The third parcel,referred to as the triangular property in this EIR,is approximately 6.5 acres and <br /> located in the northeast comer,between Austin Road and the landfill access road. This parcel is <br /> within San Joaquin County,and zoned public lands. It is currently owned by the CYA and the <br /> City would either acquire or obtain an easement for the parcel. The parcel would be used for <br /> floodplain containment during the 100 year storm event. <br /> According to the court case Lawler v.City of Redding(1992)(7 Cal.App 4th 7 78;9 Cal. <br /> Rptr.2d 392),cities and counties are exempt from each other's building and zoning-regulations, <br /> including compliance with general plans. Therefore,the City of Stockton does not need to <br /> obtain approval from San Joaquin County for use of County unincorporated area lands that are <br /> II.2 <br />
