Permitting and Enforcement Commi Agenda Item- <br /> January 15, 1998 <br /> • LEVEA Certification-A certification from the LEVEA that the permit package is complete <br /> and correct, including a statement that the RFI meets the requirements of the regulations in <br /> effect at that time the RDSI was prepared(Title 14 CCR section 18222). <br /> • LEA/EA CEQA Finding -A finding that the proposed permit is consistent with and is <br /> supported by the existing CEQA analysis. Furthermore,this project is categorically exempt <br /> from CEQA compliance under CCR Section 15301. <br /> Staff Analysis <br /> Staff have reviewed the proposed permit and the above documentation and have found that the <br /> proposed permit package has met the requirements of California Code of Regulations, Title 27 <br /> and/or Title 14 and is acceptable for the Board's consideration of concurrence. The following <br /> table summarizes Board staffs analysis: <br /> Acme Landfill Accept- Unaccept- To Be Not See Details <br /> able able Deter- Applic- in Agenda <br /> Facility No.07-AA-0002 mined able Item <br /> CIWMP Conformance(PRC 50001) <br /> CoSWMP Conformance(PRC 50000) <br /> General Plan Conformance(PRC 50000.5) <br /> Conformance With State Minimum Standards <br /> California Environmental Quality Act <br /> Closure/Post-Closure Maintenance Plan <br /> Funding for Closure/Post-Closure Maintenance <br /> Operating Liability <br /> RFI Completeness <br /> California Environmental Quality Act(CEQA) <br /> For a project subject to CEQA, state law requires compliance with the California Environmental <br /> Quality Act(CEQA); either through the-preparation, circulation, and adoption/certification of an <br /> environmental document; or by determining that the proposal is categorically or statutorily <br /> exempt. <br /> The Contra Costa County Health Services Department(LEA)has determined that this project is <br /> categorically exempt from CEQA compliance under CCR Section 15301 for purposes of their <br /> SWFP approval. <br /> Using information supplied by the LEA, ERS staff have prepared a Preliminary Study for this <br /> proposed project, and are of the opinion that the proposed changes constitute the continued <br /> operation of an existing facility involving no expansion of use beyond that previously existing. <br /> For these reasons ERS staff recommend the exemption of this proposed project under the <br /> categorical exemption described in CEQA Guidelines, CCR Section 15301. <br />
