SECTION 3 <br /> (05/06) <br /> 3-1.036 INSURANCE.--The Contractor and subcontractors will be <br /> required to obtain all insurance required under this paragraph and no work will be <br /> allowed until such insurance has been approved by the County. Copies of insurance <br /> certificates evidencing the required coverage shall be furnished to the County. <br /> Certificates of insurance must indicate that the coverage cannot be reduced or <br /> cancelled until thirty days' written notice has been furnished the County. <br /> 1. Compensation Insurance: The Contractor shall take out and <br /> maintain, during the life of this contract, workers' compensation insurance <br /> for all of his employees employed at the site of the project and, in case <br /> any work is sublet, the Contractor shall require the subcontractor similarly <br /> to provide workers' compensation insurance for all of the latter's <br /> employees. If any class of employees engaged in hazardous work under <br /> this contract at the site of the project is not protected under the Workers' <br /> Compensation Statute, the Contractor shall provide and shall cause any <br /> subcontractor to provide insurance for the protection of employees <br /> engaged in hazardous work. <br /> 2. Bodily Injury Liability and Property Damage Liability Insurance: <br /> The Contractor shall take out and maintain during the life of this contract <br /> such bodily injury liability and property damage liability insurance as shall <br /> protect him from claims for damages for personal injury, including <br /> accidental death as well as from claims for property damage, including <br /> coverage on property in the care, custody and control of the Contractor <br /> which may arise from his operations under this contract, whether such <br /> operations by himself or by any subcontractor or by anyone directly or <br /> indirectly employed by either of them, and such insurance shall be Public <br /> Liability Insurance, in an amount no less than $1,000,000 (combined <br /> . single limit) per occurrence. <br /> The above insurance shall be of the broad form coverage type, affording <br /> coverage on property in the care, custody and control of the Contractor, and it is <br /> specifically required that the exclusions commonly referred to, in the insurance industry, <br /> as the "XCU Exclusions" shall be deleted from the Contractor's insurance. Adequate <br /> proof of insurance in compliance with the above requirements shall be furnished to the <br /> County. An additional insured endorsement to Contractor's liability insurance policy <br /> naming the County, its officers and employees as additional insureds shall be furnished <br /> to the County. Notwithstanding the above, Contractor's liability insurance policy shall <br /> be endorsed as primary insurance. <br /> 3-2 <br /> (SPEMCO-3-2) <br />
