SECTION 3 <br /> (05/06) <br /> Contractor will indemnify and defend Owner from all claims, demands, or <br /> liability arising out of or encountered in connection with this contract or the prosecution <br /> of work under it, whether such claims, demands, or liability are caused by Contractor, <br /> Contractor's agents or employees, or subcontractors employed on the project, their <br /> agents or employees, or products installed on the project by Contractor or <br /> subcontractors, excepting only such injury or harm as may be caused solely and <br /> exclusively by Owner's fault or negligence. Such indemnification shall extend to claims, <br /> demands, or liability for injuries occurring after completion of the project, as well as <br /> during the work's progress. <br /> 3-1.04 RETURN OF PROPOSAL GUARANTIES.--In lieu of the provisions <br /> in Section 3-1.05, "Return of Proposal Guaranties," of the Standard Specifications, the <br /> following provisions shall apply: <br /> The proposal guaranties accompanying the proposals of all bidders will be <br /> retained until the contract has been awarded by the Board of Supervisors, after which <br /> all such guaranties, except the first lowest responsible bidder's guaranty, will be <br /> returned to the respective bidders whose proposals they accompany. The proposal <br /> guaranty of the first lowest responsible bidder will be retained until the contract <br /> documents have been fully executed and filed with the County Recorder's office. <br /> 3-3 <br /> (SPECSICO-3-3) <br />
