PAYNE <br />DEPUTY DIRECTOR <br />That the Board of Supervisors adopt the Resolution to establish a <br />Solid Waste Closure Enterprise fund in conformance with the Solid <br />40 Waste Disposal Site Hazardous Reduction Act of 1987 (ACT). <br />REASONS FOR RECOMMENDATION: <br />Assembly Bill 2248, which was signed into law by Governor <br />Deukmejian on September 28, 1987, created the ACT. It mandates <br />landfill operators to establish a trust fund, or equivalent <br />financial mechanism, to ensure adequate resources for closure and <br />postclosure maintenance activities for landfills in California. <br />The fund or an equivalent financial mechanism is to be <br />established by the operator of any Solid Waste Landfill that was <br />operating on January 1, 1988. In addition, the required <br />financial mechanism must be approved by the California Waste <br />Management Board and the San Joaquin Local Health District, and <br />it is to be established on or before January 1, 1989. <br />The County of San Joaquin as operator of the Harney Lane <br />Sanitary Landfill and in accordance with its contractual <br />obligations with Foothill Sanitary Landfill Inc., must comply <br />with the mandates of the ACT. Although the County has <br />established closure funds for the Harney Lane and Foothill <br />Sanitary Landfills, the present method used to account for the <br />funds does not meet the guidelines of the ACT. <br />
