1 A-94--11 <br />3 PLEDGE OF REVENUE AGREEMENT FOR FINANCIAL ASSURANCE FOR <br />4 POSTCLOSURE MAINTENANCE OF THE FOOTHILL SANITARY LANDFILL <br />5 UTILIZING SOLID WASTE ENTERPRISE FUND REVENUES <br />6 <br />7 THIS AGREEMENT, made and entered into HOV 2 2 19% <br />8 by and' between the COUNTY OF SAN JOAQUIN, a political subdivision <br />9 of the State of California, hereinafter referred to as "COUNTY", <br />10 and the California Integrated Waste Management Board, hereinafter <br />11 referred to as "BOARD", establishes a Pledge of Revenue to assure <br />12 that adequate funds are available to carry out the postclosure <br />13 maintenance of the Foothill Sanitary Landfill. <br />14 W I T N E S E T H <br />WHEREAS, the COUNTY owns the Foothill Sanitary Landfill, <br />16 hereinafter referred to as "LANDFILL", in conformance with the <br />17 findings, conditions, prohibitions, and requirements contained in <br />18 Solid Waste Facilities Permit No. 39 -AA -0004 issued by the COUNTY <br />19 Environmental Health Division serving as Local Enforcement Agency <br />20 for the BOARD; and <br />21 WHEREAS, the LANDFILL began accepting waste in the early <br />22 1960s; and <br />23 WHEREAS, California Public Resources Code, Sections 43500 <br />24 through 43610, and sections of Title 14 of the California Code of <br />25 Regulations ("Regulations"), Division 7, Chapter 5, Article 3.5, <br />26 require operators of solid waste landfills to demonstrate the <br />availability of financial resources to conduct postclosure <br />-1- <br />
