1 maintenance activities; and <br />2 WHEREAS, Sections 18283 and 18290 of the Regulations specify a <br />3 pledge of revenue as an acceptable mechanism to demonstrate <br />4 financial responsibility for postclosure maintenance costs of a <br />5 solid waste landfill; and <br />6 WHEREAS, the COUNTY established by Resolution R-74-3362 dated <br />7 November 26, 1974, the Solid Waste Enterprise Fund to ensure <br />8 adequate resources for operating expenses for the COUNTY owned and <br />9 operated refuse disposal facilities; and <br />10 WHEREAS, on December 6, 1988, by Resolution R-88-1323, the <br />11 COUNTY, as owner of the LANDFILL, complied with Public Resources <br />12 Code Sections 43500 through 43610 and sections of the Regulations, <br />13 Division 7, Chapter 5, Article 3.5, by establishing the Solid Waste <br />14 Closure Enterprise Fund for the Harney Lane Sanitary Landfill and <br />15 the LANDFILL; and <br />16 WHEREAS, the COUNTY'S Director of Public Works is responsible <br />17 for the administration of the Solid Waste Enterprise Fund; and <br />18 WHEREAS, the COUNTY has determined that projected net revenues <br />19 from the Solid Waste Enterprise Fund, derived from user fees <br />20 charged for the use of the COUNTY'S solid waste facilities which <br />21 include the Lovelace Transfer Station (39 -AA -0008), during the <br />22 thirty (30) year period of postclosure maintenance of the LANDFILL, <br />23 shall be greater during each year of this period than the yearly <br />24 monitoring and postclosure maintenance costs contained in the most <br />25 recent cost estimate for the LANDFILL, which has been submitted to <br />26 the BOARD in accordance with Section 18266 of the Regulations; <br />27 NOW, THEREFORE, the parties hereto mutually agree as follows: 0 <br />-2- <br />
