1 1. The COUNTY hereby establishes a pledge of revenue as the <br />financial mechanism for postclosure maintenance of the <br />3 LANDFILL in accordance with Sections 18283 and 18290 of the <br />4 Regulations to replace the LANDFILL'S postclosure sub -budget <br />5 unit mechanism which was established to provide for <br />6 postclosure maintenance. <br />7 2. The COUNTY shall transfer funds that were previously dedicated <br />8 for postclosure maintenance of the LANDFILL in the Solid Waste <br />9 Closure Enterprise Fund to the sub -budget unit of the Solid <br />10 Waste Closure Enterprise Fund for the LANDFILL closure <br />11 activities. <br />12 3. The COUNTY agrees to pledge net revenues from the Solid Waste <br />13 Enterprise Fund as described herein. <br />14 4. The amount of the pledged revenue shall be equal to the <br />approved postclosure maintenance cost of $63,620 per year for <br />16 the thirty (30) year period of postclosure maintenance, <br />17 representing the most recent monitoring and postclosure <br />18 maintenance cost estimate for the LANDFILL and the most recent <br />19 annual inflation/deflation factor as reported in BOARD <br />20 Form 114A. It is agreed that the amount of this pledge may <br />21 increase or decrease to match any adjustment to the identified <br />22 cost estimate which is mutually agreed to by the COUNTY and <br />23 the BOARD. <br />24 5. If the COUNTY ceases at any time to retain control of its <br />25 ability to allocate the pledged revenue as identified herein <br />26 to pay postclosure maintenance costs, the COUNTY shall notify <br />,�7the BOARD and the local enforcement agency and shall obtain <br />0 <br />-3- <br />
