PART 3 EXECUTION <br /> 3.1 TEMPORARY CONSTRUCTION <br /> A. Fencing and Barricades: <br /> 1. Security Fence: <br /> a. CONTRACTOR shall provide required security fencing for the <br /> CONTRACTOR's materials and equipment. Use of the OWNER's <br /> fenced area shall be at the CONTRACTOR's own risk, and the <br /> OWNER shall not be held liable for any damage to or loss of <br /> materials or equipment located within the fenced area. <br /> CONTRACTOR shall arrange with the OWNER for the locking <br /> mechanism required at the existing gate for construction use. <br /> b. Where existing fencing is used or modified for security fence, restore <br /> to original condition at completion of the Work. <br /> 3.2 SAFETY AND PROTECTION <br /> A. Safety Requirements: <br /> 1. CONTRACTOR shall do whatever Work is necessary for safety and be <br /> solely and completely responsible for conditions of the jobsite, including <br /> safety of all persons (including employees) and property during the Contract <br /> period. This requirement shall apply continuously and not be limited to <br /> normal working hours. <br /> 2. Safety provisions shall conform to Federal and State Departments of Labor <br /> Occupational Safety and Health Act (OSHA), and other applicable federal, <br /> state, county, and local laws, ordinances, codes, requirements set forth <br /> herein, and regulations that may be specified in other parts of these Contract <br /> Documents. Where these are in conflict, the more stringent requirement <br /> shall be followed. CONTRACTOR shall become thoroughly familiar with <br /> governing safety provisions and shall comply with the obligations set forth <br /> therein. <br /> 3. CONTRACTOR shall develop and maintain for the duration of the <br /> Contract, a safety program that will effectively incorporate and implement <br /> required safety provisions. CONTRACTOR shall appoint a qualified <br /> employee who is authorized to supervise and enforce compliance with the <br /> safety program. <br /> 4. OWNER, DESIGN ENGINEER, or QA/QC CONSULTANT's duty to <br /> conduct construction review of the CONTRACTOR's performance is not <br /> intended to include a review or approval of the adequacy of <br /> CONTRACTOR's safety supervisor, safety program, or safety measures <br /> taken in, on, or near the construction site. <br /> 5. As part of safety program, CONTRACTOR shall maintain at its office or <br /> other well-known place at the jobsite, safety equipment applicable to the <br /> Work as prescribed by the governing safety authorities, and articles <br /> necessary for giving first-aid to the injured.
