Referral <br /> On August 2, 2005, Forward Inc. submitted a proposed amendment to their Joint <br /> Technical Document(JTD). The Environmental Health Department(EHD)rejected the <br /> JTD amendment on August 23, 2005 (see exhibit 1). <br /> On November 30, 2005, Robert McClellon received an e-mail form Curt Fujii, of Allied <br /> Waste. The e-mail contained an attachment. The attachment was a draft of the Clean Soil <br /> Definition Letter(see exhibit 2). <br /> On December 12, 2005, Robert McClellon responded to Mr. Fujii regarding the draft <br /> Clean Soil Definition Letter in an e-mail. Mr. Fujii e-mailed back and indicated that he <br /> would make the appropriate changes (see exhibit 3). <br /> On December 14, 2005, Robert McClellon received an e-mail from Curt Fujii of Allied <br /> Waste requesting a meeting to discuss the clean soil definition and diverted materials (see <br /> exhibit 4). <br /> On December 22, 2005, a meeting was held at the EHD office. The meeting was to <br /> discuss the tonnage limit at Forward Inc. and the materials that would count for the <br /> purposes of maximum daily tonnage the facility could accept. During that meeting <br /> Forward Inc. was represented by Mike Caprio,Kevin Basso, Curt Fuji, Sangeeta Lewis <br /> and Lochilin Caffey. Robert McClellon and Michael Kith represented the EHD. Sangeeta <br /> Lewis a consultant for the Forward Inc. landfill had prepared a letter regarding her <br /> position on the tonnage being used for cover and that she felt that the Solid Waste <br /> Facility Permit, JTD and CEQA allows Forward to accept soil and various forms of ADC <br /> to use as cover and not count that waste against the daily maximum tonnage. Ms. Lewis <br /> provided a document that was excerpts from the JTD (pages 4-9 through 4-11 and table <br /> 8). Robert McClellon briefly reviewed Table 8 of the documents and explained that Table <br /> ( 8 describes the sequence that the site will construct waste cells and when those areas will <br /> Page 1 of 2 <br />
