be filled. Table 8 provides a corresponding date as to when a proposed sequence will be <br /> completed. According to the sequencing map the site is currently in Phase 5. Phase 5 has <br /> the projected date of completion as January 2013. Ms. Lewis began to argue over the <br /> approvals the site has and that the waste that is diverted for other uses onsite have been <br /> considered when looking at the site volume and the closure date. Robert McClellon <br /> indicated to the Forward Inc. representatives that they could leave the information with <br /> him and he would review it and make a formal decision. Mike Caprio indicated that he <br /> was willing to wait for the formal decision regarding the issue. The definition of clean <br /> soil was discussed. Curt Fujii was concerned about the additional testing requirements <br /> and when they would apply. Robert McClellon indicated that the Soluble Threshold <br /> Limit Concentration(STLC)test would be required when the Total Threshold Limit <br /> Concentration(TTLC) exceeded ten fold the STLC value. Robert McClellon indicated <br /> that he would follow up with Ross Atkinson of the California Regional Water Quality <br /> Control Board(CRWQCB) (see exhibit 5). <br /> On December 28, 2005, Robert McClellon of the EHD called Ross Atkinson of the <br /> CRWQCB and spoke with him regarding the ten-fold dilution regarding STLC and <br /> TTLC. Mr. Atkinson indicated the he would talk with Jon Marshack, and get back to him. <br /> Robert McClellon e-mailed Curt Fujii and informed him of the conversation(see exhibit <br /> 6). <br /> On January 31, 2006, The EHD received an application to amend the JTD for the <br /> Forward Inc. landfill. The amendment was rejected by the EHD on March 17, 2006 (see <br /> exhibit 7). <br /> On February 27, 2006, Robert McClellon received an email from Curt Fujii of Allied <br /> Waste. The e-mail was a response to a request that Forward Inc. provide some date as to <br /> the implementation for the clean soil diversion process (see exhibit 8). <br /> On May 23, 2006, the EHD received an application to amend the JTD for the Forward <br /> Inc. landfill.
