(3)... (b) -(f)." <br /> Board staff and:the LEA measured methane gas levels at three multidepth probes (GP-9, GP-11 & GP-12), <br /> using the operator's LandTec GEM -500 instrument. We obtained methane gas readings of 0.00%in all <br /> depths of#GP=9, on monitoring probe#GP-12,we obtained methane gas readings ranging from 1.1 to 3.2%, <br /> and on GP-1 I,we obtained methane gas-readings of 13.2%in the Shallow Depth, 23.9%in the Medium <br /> Depth, and 0.00%in the Deep probe. The levels of methane gas obtained in the shallow and medium depths <br /> on landfill boundary monitoring probe#GP-11 constitute a violation relative to the requirement of the State <br /> Minimum Standard(SMS) indicated above. <br /> Area of Concern: <br /> 27 CCR Section 20921(b) -Gas Monitoring and Control <br /> On April 19,2007,the California Integrated Waste Management Board(CIWMB)revised its regulations <br /> governing landfill gas (LFG)monitoring and control for active disposal sites. The new regulations apply to <br /> active disposal sites the more detailed gas monitoring and control regulations previously applicable to only <br /> closed sites. The Office of Administrative Law (OAL) approved the regulations on August 21,2007. The <br /> regulations became effective on September 20,2007. The new regulations require operators of active landfills <br /> to submit LFG Program Plans(Plans)that demonstrate compliance with the LFG monitoring criteria to the <br /> Enforcement Agency(EA)and CIWMB for EA review and approval and CIWMB review and concurrence. <br /> The regulations required that active disposal sites which are permitted to receive greater than 20 tons of waste <br /> per operating day shallcomply with the new requirements by September 21,2008. <br /> On August 19,2008,the CIWMB proposed.to revise the regulations yet again,to extend the deadline for <br /> compliance with 27 CCR-20921 - Gas Monitoring and ControL The proposed revised regulations kept the <br /> -requirement to submit the Plans for active disposal sites that receive greater than 20 tons per day by <br /> September 21,2008. However,the proposed revised regulations also contain a provision that the landfill <br /> operators will not have to fully implement the Plans as approved by the EA and concurred with the GIWMB <br /> until eight months after the effective date of the proposed regulations or September 21,2009,whichever is <br /> later. 'The Plans for the Forward Landfill,Inc.were submitted to the LEA on September 16,2008. Because <br />
