XI. On October 1, 2010, the SCS Engineers, on behalf of the operator, has submitted <br /> the work plan for landfill gas system upgrade and perimeter probe construction <br /> (work plan)to LEA for review. The LEA has reviewed the work plan, and <br /> comments have been formulated to address the discrepancies and/or deficiencies. <br /> The LEA will communicate with the operator or his/her designee to resolve all <br /> issues prior to approving the work plan. <br /> XII. To date, the LEA has not received quarterly gas monitoring report as directed in <br /> item i of Self Monitoring section of the Solid Waste Facility Permit. <br /> THEREFORE,PURSUANT TO PUBLIC RESOURCES CODE.DIVISIOIN 30 <br /> AND CALIFORNIA CODE OF REGULATIONS,TITLE 27,DIVIDSION 7, <br /> FORWARD INCORPORATED IS HEREBYO E T : <br /> 1. Continue routine explosive gas monitoring program. The monitoring program <br /> shall include, but not limited to, the evaluation of the existing gas monitoring <br /> probes and the concentration of landfill gas in the ambient air at ground surface. <br /> The minimum frequency of monitoring shall be monthly. <br /> 2. Submit gas monitoring reports to this LEA in accordance with the following <br /> schedule: <br /> Monitoring Period Reporting Deadline <br /> January-March April 30 <br /> April-June July 30 <br /> July-September October 30 <br /> October-December January 30 <br /> 3. Within 7 days of work plan approval,the operator shall implement the work plan <br /> in phases. The operator shall evaluate the effectiveness of each phase and submit <br /> result, including site map of the location of all gas wells to LEA. <br /> 4. If the work plan implementation fails to reduce the concentration of methane gas <br /> below 5%by volume at the permitted property boundaries by March 31, 2011,the <br /> operator shall submit a new corrective action plan by April 30, 2011. The new <br /> corrective action plan shall include, but not limited to, study of gas migration at <br /> the above-mentioned facility,the proposed action and schedule for compliance. <br /> 5. If the work-plan implementation succeeds in obtaining less than 5% of methane <br /> gas at the permitted property boundaries,the operator shall continue monitoring <br /> and reporting at described in item 1 and 2 for 4 consecutive quarters. <br /> 6. The operator shall achieve full compliance with 27CCR 20921(a)(2)—Gas <br /> Monitoring and Control and maintain the concentration of methane gas below 5% <br /> by volume at the permitted property boundaries by September 28. 2011. <br /> Notice and Order 10-01 Page 3 of 5 Forward Landfill <br /> October 14,2010 <br />
