PLEASE TAKE FURTHER NOTICE: A. Failure to correct the above violation by September 28, 2011 could result in a civil penalty not to exceed ten thousand dollars ($10,000) for each day the violation occurs, as cited in PRC 45023 or in the suspension or revocation of the solid waste facility permit as cited in PRC 44305 and 44306. Forward Incorporated may also be subjected to a civil penalty, to be imposed administratively by the LEA,not to exceed five thousand dollars ($5,000) for each day the violation occurs, as cited in PRC 45011(a). B. Pursuant to PRC 44307 and 44310, the owner/operator have the right to appeal the Notice and Order to the Solid Waste Independent Hearing Panel within 15 days of receipt of this Notice and Order. Nothing in this Notice and Order shall constitute or be construed as a satisfaction or release from liability for any conditions or claims arising as a result of past, current or future operation of the Owner. Notwithstanding compliance with the terms of this Notice and Order,the Owner may be required to take further actions as are necessary to protect human health and the environment. This Notice and Order is supported by the accompanying declaration of Michael Kith, Lead Senior Registered Environmental Health Specialist of the San Joaquin County Environmental Health Department. This Notice and Order does not release the Owner from complying with all other local, state and federal requirements. This Notice and Order may only be amended in writing by an appropriate representative of the San Joaquin County Environmental Health Department.
