Caroll Mortensen <br />January 13, 2012 <br />Page 7 <br />Apparently recognizing the failure of the SWFP ND to address these <br />operational impacts, the LEA asserts that a 2003 EIR (SCH # 2001052081) "allows the <br />site to operate on Sundays." See LEA November 21, 2011 Notice of Public Information <br />Meeting, attached. Yet the LEA has provided no documentation that the 2003 DEIR did <br />in fact explicitly analyze the environmental impacts that would result from Sunday <br />operations. One would expect, the SWFP ND would have, at the very least, included a <br />summary of the applicable analysis from the 2003 DEIR. <br />Nor does the SWFP ND acknowledge that, according to the California <br />Integrated Waste Management Board ("CIWMB") (now Cairecycle), the terms and <br />conditions of the landfill's 2003 Permit issued by the LEA restrict facility operations and <br />receipt of waste and operation hours to ten Sundays per year. See CIWMB Resolution <br />2003-323 (Revised) (emphasis added), attached. This restriction exists in light of any <br />analysis that may have been undertaken in the 2003 EIR. Moreover, as discussed below, <br />this restriction was likely imposed to protect nearby residents' quality of life and, <br />therefore, operating the facility an additional ten Sundays per year would necessarily <br />adversely impact area residents. <br />1. The Increase in Sunday Operations Will Have Potentially <br />Significant Impacts on Transportation -Related Public Safety. <br />The Forward Landfill is located in a rural, agricultural community. <br />Currently on those Sundays when the landfill does not operate, traffic volumes on area <br />roadways are relatively low. If approved, the SWFP Revision would result in the <br />addition of up to 1,240 daily landfill -related truck trips on area roadways on ten <br />additional Sundays per year. This substantial increase in truck trips has the potential to <br />adversely impact traffic operations and result in an elevated risk of accidents. <br />Bicyclists, in particular, would be exposed to an elevated risk of accidents <br />as landfill -related trucks routinely travel on two area roadways that are currently used by <br />bicycles. The Unincorporated San Joaquin County Bikeway Plan identifies the portion <br />of Mariposa Road extending east from Austin Road as a "Roads Currently Used by <br />Bicyclists" and French Camp Road is a proposed Class 3 Bike Route. 2010 DEIR at <br />IV.B-3. The use of these roadways by bicyclists is likely to be much higher on weekends <br />then weekdays since the majority of recreational bicycle riding occurs on the weekend. <br />The increase in truck and vehicular travel resulting from the SWFP Revision has the <br />'SHUTEJ MIHALY <br />�.._WEINBERGERu-P <br />
