1 .5 COMPLIANCE WITH SITING GUIDELINES <br /> The DHS's Guidelines for the Preparation of Hazardous Waste Mana ea ment <br /> (June 30, 1987) specify that CHWMPs provide siting criteria for a full <br /> range of types and sizes of hazardous waste management facilities. <br /> However, Section 25135. 1(d) (5) of AB 2948 specifies that the Plan <br /> should determine the need for facilities based on projected county <br /> needs. This has created a conflict between the counties and the DHS. <br /> In response to requests from local officials, DHS issued the following <br /> statement, which is hereby incorporated in the CHWMP: <br /> "The Department of Health Services has established that a <br /> specified hazardous waste facility project may be considered <br /> inconsistent with the plan if it is not demonstrated at the <br /> time that land use decision is made, that the county lacks <br /> all of the following: <br /> (a) existing permitted and operating hazardous waste <br /> capacity in the county with sufficient capabilities <br /> available to appropriately manage all hazardous wastes <br /> of the county proposed to be managed by the proposed <br /> facility <br /> (b) hazardous waste capacity which will be available in the <br /> county to appropriately manage all the hazardous wastes <br /> of the county proposed to be managed by the proposed <br /> facility, which has received all local siting approv- <br /> als, and which is pending formal federal or state <br /> permit approval within one year <br /> (c) effective formal agreements with one or more California <br /> counties which have an existing facility or which will <br /> accept the siting of a new or expanded facility, to <br /> appropriately manage all the hazardous multiuser wastes <br /> of the county proposed to be managed by the proposed <br /> facility; or <br /> (d) documentation of effective contracts between hazardous <br /> waste generators in the county and facilities in one or <br /> more California counties to appropriately manage all <br /> the hazardous wastes of the county proposed to be <br /> managed by the proposed facility. <br /> "For purposes of this provision, 'manage' means to manage <br /> hazardous waste as effectively and economically as would the <br /> proposed facility throughout a period equivalent to the <br /> useful life of the proposed facility.
