to lessening potential risk of environmental damage posed by <br /> current hazardous waste management, and to conforming to <br /> anticipated standards of state and federal agencies. <br /> "The local legislative body's finding of a proposed facili - <br /> ty's consistency with the county hazardous waste management <br /> plan shall be based on consistency with need and other <br /> factors specified in Subdivision (f) (5) of Section 25199. 11 <br /> of the Health and Safety Code demonstrated at the time the <br /> legislative body's decision is made, and on consistency with <br /> siting criteria and other provisions of the plan." <br /> The CHWMP has determined a need for SQG transfer stations. <br /> Accordingly, it establishes the criteria for locating such facilities <br /> and has identified candidate areas. The Plan also recognizes the need <br /> for cooperating with other counties in establishing hazardous waste <br /> facilities to meet multicounty needs. The Plan recommends that the — <br /> County develop multicounty agreements to site hazardous waste <br /> facilities. If multicounty agreements are developed that require <br /> hazardous waste facilities within the County, the County will develop <br /> siting criteria and identify candidate areas for such facilities'. In <br /> this event, the CHWMP shall be amended to incorporate such criteria <br /> and candidate areas. All such amendments to the CHWMP must be <br /> approved by a majority of the cities that represent a majority of the <br /> population, as well as by the County Board of Supervisors and the DHS. <br /> 1.6 COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) <br /> The CEQA was enacted to protect the State's environment, the health of <br /> its citizens, and the well being of the economy. Under CEQA, the <br /> CHWMP is considered a "discretionary" project that required an Envi- <br /> ronmental Impact Report (EIR) . General plans, rezonings, variances, <br /> and conditional or special use permits are discretionary by virtue of <br /> the fact that local governments use discretion, usually through their <br /> advisory and legislative bodies, in deciding to approve or deny the <br /> permit (Section 15357, CEQA Guidelines) . <br /> T <br /> PJ9 9390502D.00D 1- . 1 11 08 10 Rev. 88/ / <br />
