if they are improperly stored or disposed of. Thus, pesticides that <br /> are found in soils as a result of improper storage would be treated as <br /> hazardous wastes. Also in the category of hazardous wastes are <br /> pesticide containers that are not properly rinsed prior to their <br /> disposal . Accidental spills of pesticides also are treated as hazard- <br /> ous wastes. <br /> Section l of the Tanner Bill emphasizes the importance of local <br /> responsibility for the safe management of hazardous wastes. Other <br /> elements of the statute are summarized below. <br /> • "The safe transport of hazardous wastes from the source <br /> of generation to the point of ultimate disposal is an <br /> important element in the total management of, hazardous <br /> waste. Strong enforcement of existing law regarding the <br /> manifest system, vehicle safety, and emergency response <br /> preparedness must be assured to provide for the full <br /> protection of public health and the environment. <br /> • A solution to the safe and responsible management of <br /> hazardous wastes also requires .improved programs of waste <br /> source reduction and recycling, and encouraging on-site <br /> treatment of hazardous wastes, as preferable to the <br /> siting of new land disposal facilities. The goal of this <br /> act, which recognizes the long-term health, environmen- <br /> tal , and economic risks of hazardous waste land disposal , <br /> is to prevent hazardous waste from being permanently dis- <br /> posed into land, or emitted into the air, without being <br /> processed by an economically and technically feasible <br /> alternative technology. <br /> • The bill would also establish procedures for appealing a <br /> local agency land use decision concerning the siting and <br /> construction, or expansion of, an off-site hazardous <br /> waste facility serving more than one hazardous waste <br /> generator. The bill would require an appeal to be <br /> authorized by the Governor or the Governor's designee, <br /> would provide for the establishment of an appeal board to <br /> review the appeal , and would specify the procedures and <br /> determinations which the appeal board is required to fol - <br /> low in agreeing with, reversing, or modifying a local <br /> agency' s land use decision. <br /> • This bill would authorize a city or county in which there <br /> is located an off-site, multiplier hazardous waste <br /> facility, as defined, to impose a tax, for general <br /> purposes, or a user fee upon the operation of the <br /> PJ9 9390502D.00D 1-3 Rev. 1 11/08/88 <br />
