i <br /> facility, up to an amount equal to 10 percent of the <br /> facility's annual gross receipts for hazardous waste <br /> treated, stored, or disposed of at that facility, except <br /> as specified.°° <br /> The CHWMP must contain an analysis of the hazardous waste stream, a w <br /> determination of the need for facilities to manage the waste, and an <br /> identification of candidate locations for new or expanded facilities. <br /> The Tanner legislation requires that: <br /> • An advisory committee must be formed to assist in prepa- <br /> ration of the Plan. The committee should contain repre- <br /> sentatives from City governments, the public, industry, <br /> environmental groups, agriculture, labor, farm workers, <br /> military, and technical professionals (chemists, engi - <br /> neers, geologists) . <br /> • The Plan must be approved by a majority of the cities in <br /> the County that contain a majority of the population. <br /> AB 2948 outlinesrocedures for approval of new or expanded facili - <br /> ties. Such facilities will have to be determined consistent with the <br /> County Hazardous Waste Management Plan, as well as with applicable <br /> General Plan and Zoning ordinances. Also included in AB 2948 are <br /> procedures for governmental approvals, coordinated permit review, and <br /> limited administrative appeals of applications for permits for new <br /> hazardous waste management facilities. <br /> 1 .2 LEGISLATION BANNING LAND DISPOSAL <br /> The 1984 federal Hazardous and Solid Waste Amendments (HSW ) to the <br /> Resource Conservation and Recovery Act ( CA) mandate a nationwide <br /> phaseout of disposal of all untreated hazardous wastes on the land by <br /> 1992 -- including disposal in landfills, pits, surface impoundments, <br /> injection wells, or similar facilities. <br /> The HWSA establishes a statutory presumption against land disposal of <br /> all untreated hazardous wastes unless the U.S. Environmental Protec- <br /> tion Agency (EPA) specifically finds that such a ban for a particular <br /> PJ9 9390502D.00D 1-4 v. 1 11/08/88 <br />
