iL <br />r <br />r] <br />u <br />11 <br />SECTION 7 <br />(4/90) <br />SECTION 7. LEGAL RELATIONS AND RESPONSIBILITY <br />7-1.01 GENERAL.—Attention is directed to the provisions in Section 7, <br />"Legal Relations and Responsibility," of the Standard Specifications and these special <br />provisions. <br />7-1.02 RESPONSIBILITY FOR DAMAGE. --The fifth paragraph in Section <br />7-1.12, "Responsibility for Damage," of the Standard Specifications is amended to read: <br />It is the intent of the parties that the Contractor will indemnify and hold <br />harmless the County, its officers and employees. from any and all claims, <br />suits or actions as set forth above regardless of the existence or degree of <br />fault of negligence on the part of the County, the Contractor, the <br />subcontractor or employee of any of these, other than active negligence of <br />the County, its officers and employees. <br />7-1.03 WORK ON PRIVATE PROPERTY. --If the plans or specifications <br />require work to be done on private property, then in all such cases prior to the award of <br />the contract, County will have obtained the consent of the owner of said property for the <br />work to be performed. Prior to the bid opening date, the Contractor shall satisfy himself <br />as to the legal sufficiency of the consent obtained by the County, and the submission of <br />a bid by the Contractor shall constitute his- approval thereof. Thereafter, the Contractor <br />shall perform the work on private property required by the contract. <br />7-1.04 LEGAL ACTION AGAINST COUNTY. --In the event litigation is <br />brought against County concerning compliance by County with State or Federal laws, <br />rules or regulations applicable to this contract, the provisions of Section 7-1.125 of the <br />Standard Specifications shall apply. <br />7-1.05 LABOR NONDISCRIMINATION. --Attention is directed to the <br />following Notice that is required by Chapter 5 of Division 4 of Title 2, California <br />Administrative Code. <br />NOTICE OF REQUIREMENT FOR NONDISCRIMINATION PROGRAM <br />(GOV. CODE, SECTION 12990) <br />Your attention is called to the "Nondiscrimination Clause," set forth in <br />Section 7-1.01A(4), "Labor Nondiscrimination," of the Standard Specifications, which <br />is applicable to all nonexempt state contracts and subcontracts, and to the "Standard <br />California Nondiscrimination Construction Contract Specifications" set forth therein. <br />The Specifications are applicable to all nonexempt state construction contracts and <br />subcontracts of $5,000 or more. <br />7-1 <br />(SPECSWASTEMCO-7-1) <br />
