LEGAL RELATIONS AND RESPONSIBILITY 7-1.01 GENERAL.—Attention is directed to the provisions in Section 7, "Legal Relations and Responsibility," of the Standard Specifications and these special provisions. 7-1.02 RESPONSIBILITY FOR DAMAGE. --The fifth paragraph in Section 7-1.12, "Responsibility for Damage," of the Standard Specifications is amended to read: It is the intent of the parties that the Contractor will indemnify and hold harmless the County, its officers and employees. from any and all claims, suits or actions as set forth above regardless of the existence or degree of fault of negligence on the part of the County, the Contractor, the subcontractor or employee of any of these, other than active negligence of the County, its officers and employees. 7-1.03 WORK ON PRIVATE PROPERTY. --If the plans or specifications require work to be done on private property, then in all such cases prior to the award of the contract, County will have obtained the consent of the owner of said property for the work to be performed. Prior to the bid opening date, the Contractor shall satisfy himself as to the legal sufficiency of the consent obtained by the County, and the submission of a bid by the Contractor shall constitute his- approval thereof. Thereafter, the Contractor shall perform the work on private property required by the contract. 7-1.04 LEGAL ACTION AGAINST COUNTY. --In the event litigation is brought against County concerning compliance by County with State or Federal laws, rules or regulations applicable to this contract, the provisions of Section 7-1.125 of the Standard Specifications shall apply. 7-1.05 LABOR NONDISCRIMINATION. --Attention is directed to the following Notice that is required by Chapter 5 of Division 4 of Title 2, California Administrative Code. NOTICE OF REQUIREMENT FOR NONDISCRIMINATION PROGRAM (GOV. CODE, SECTION 12990) Your attention is called to the "Nondiscrimination Clause," set forth in Section 7-1.01A(4), "Labor Nondiscrimination," of the Standard Specifications, which is applicable to all nonexempt state contracts and subcontracts, and to the "Standard California Nondiscrimination Construction Contract Specifications" set forth therein. The Specifications are applicable to all nonexempt state construction contracts and subcontracts of $5,000 or more. 7-1 (SPECSWASTEMCO-7-1)
