2. "Fixed Assets" means land and all fixtures thereto. <br /> 3. CITY ,hall operate and manage the AREA and shall furnish all <br /> personnel, services, supplies, and equipment necessary for. the proper <br /> operation of the AREA. None of the persons working at the AREA shall be <br /> employees of COUNTY, but shall be employees or independent contractors of <br /> CITY. COUNTY shall have no right or authority to direct.., manage, or <br /> control the employees and independent contractors of CI`17. <br /> u. The manner of operation of the AREA by CITY shall be mutually <br /> agreeable to the parties hereto. <br /> 5. The use of the AREA for disposal shall be made available to all <br /> residents of the City of Tracy and the unincorporated areas of San Joaquin <br /> County. <br /> i <br /> 6. The fees to be charged the public for use of the AREA and its <br /> hours of operation shall be those agreed upon by the parties hereto. <br /> 7. On or about May 1 every year, CITY shall submit to COUNTY a <br /> proposed budget for the ensuing fiscal year commencing the following <br /> July 1 and expiring on June 30. Within 60 days after submission of said <br /> budget, COUNTY shall notify CITY of its approval. <br /> $. On or about August 1 every year, CITY shall submit to COUNTY <br /> a statement of the costs of operations of the AREA for the previous <br /> fiscal year period commencing on July 1 to June 30, inclusive. . The costs <br /> of operations for the annual period shall include all actual expenditures j <br /> in the operation and management of said dump facilities, including <br /> fifteen per cent (15�) of actual expenditures-to cover overhead expended } <br /> in said activity less revenue derived from fees charged the public and <br /> sales of salvaged materials to arrive at a net operating cost. <br /> { <br /> on or about October 1, the COUNTY shall pa�: to <br /> ` i <br /> CIVi o:._- ll/2) of t:i: COM71"Y:;, share of the budget submltted or.
