PAYNE <br />DEPUTY DIRECTOR <br />The following information is being supplied in response to your <br />question as to whether the French Camp Landfill is in compliance <br />with the 1986 County Solid Waste Management Plan (COSWMP). <br />As you know, the laws which provided for the preparation, review, <br />revision, and finding of conformance to COSWMPs were repealed as <br />of January 1, 1990, by Assembly Bill 939. When the law existed, <br />it required the lead agency (Public Works in San Joaquin County) <br />responsible for maintaining the COSWMP to make a finding of <br />conformance to the COSWMP for any new or expanded facilities. <br />The COSWMPs were required to be reviewed every three years, and <br />revised when necessary. There were no expiration dates for <br />COSWMPs. Once approved by the California Waste Management Board <br />(Board), they continued to be in effect until revised. Even when <br />the law was repealed on January 1, 1990, they continued to be in <br />effect as local plans. <br />FINDING OF CONFORMANCE <br />As mentioned above, the law that required a finding of conformance <br />to the COSWMP was repealed. This created a period of time from <br />January 1, 1990, until the new Countywide Integrated Waste <br />
