Several small shallow settlement depressions have developed in the cover, some of the <br /> depressions show evidence of previous storm-water ponding from last winter; there are numerous deep <br /> truck ruts that collect storm-water apparently left from fall 2004;the perimeter drainage v-ditch is locally <br /> silted in and overgrown; the down-drains need repair and sections of the silt fence surrounding the soil <br /> stockpile have fallen down. <br /> Failure to maintain the facility cover is a violation of waste discharge requirements and of Title 27 <br /> California Code of Regulations. Waste Discharge Requirements Order No. R5-2004-0159 Facility <br /> Specification CA. states: "The Discharger shall maintain in good working order any facility, control <br /> system or monitoring device... ". The interim cover and storm-water controls have not been maintained <br /> over the previous year and at this time are not ready for the 2005/06 rainy season. <br /> In summary, the Dischargers have not maintained the landfill cover and storm-water controls.
